The case of a female student studying in the United States who claimed to be raped by her 60-year-old father when she returned to Hong Kong to avoid the epidemic three years ago was resumed in the High Court today (12th), and the mother Y of the victim X continued to testify.

During the cross-examination, the defense stated the facts of the case, and pointed out that X reacted greatly after learning that the defendant had an extramarital affair.

Y denied the claims and said, "I believe I am a girl."

The defendant, aged 62, was charged with raping X at his residence from March 18 to March 31, 2020.

He was also charged with rape and indecent assault at his residence on a certain day in April of the same year.

X was 19 years old at the time of the incident.

The 62-year-old defendant denies two counts of rape and the case is awaiting trial in court.

The defense alleges that Y and the defendant had been in bed together in different dreams

The defense pointed out that since Y found out that the defendant was flirting with the Latin dancer partner, and suspected that the defendant had an extramarital affair, Y and the defendant had been in bed together, and their contact was only about their children.

The defense also read out the divorce documents filed by Y, which did not mention the defendant's involvement in the rape of X.

Y responded that the divorce was filed for the defendant's infidelity, "I can't do it to me", but the rape of X was "I can't do it to a woman".

She continued that rape was a criminal offense, and the matter was finally reported to the police, while the divorce was a matter for the family court, emphasizing: "He had a woman and was unfaithful." She also said that this was enough to apply for a divorce.

The defense immediately pointed out that the defendant's extramarital affair was Y's only dissatisfaction, and the defendant did not rape X.

Y immediately responded, "Yes... I believe I am a girl."

The defense later revealed the facts of the case. It was Y who told his daughter X about the defendant's extramarital affairs.

X also said that he would allege that he was raped by the defendant in a hotel room in Shanghai, and Y echoed his proposal.

Y once asked his lawyer whether the incident that happened in Shanghai could be reported in Hong Kong.

Later, Y told X that he was also sexually assaulted in Hong Kong.

Y denied everything.

The defense also asked why Y did not call the police about one month after learning about the sexual assault.

Y said that the lawyer explained at the time that if Y applied for divorce, the defendant would need to sign and receive the divorce petition. At the same time, if he reported the sexual assault incident to the police, he could not determine what action the police would take, and the defendant might not be able to sign and receive the petition.

The defense pointed out that Y reported the incident to the police and sent a divorce petition to the defendant on the same day, December 11, because Y's master counted his days.

Y denied both.
