In the
410 pages
that make up the Political Trial project against the Supreme Court, the ruling party advances some tools that it will use to defend its accusation.
Beyond summoning the four magistrates, it will request
reports from more than 10 organizations
and will summon dozens of witnesses, including
governors and national officials
.
As it had already been anticipated, the legislators will call Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti to testify, who do not have the obligation to attend.
From the beginning, the president of the commission, the pro-government Carolina Gaillard, clarified that they would be summoned not only for questioning, but also that as defendants they have the right to defend themselves.
But in the category of witnesses the list of summoned extends.
It is that the complaints against the leaders not only include the ruling that declared the reform of the Magistracy of 2006 unconstitutional and the one that forced the Nation to increase the co-participation to the City.
The deputies also included the
2x1 ruling in the "Muiña" case
for crimes against humanity, and the cause of mismanagement in the Obra Social by the judicial officers.
witnesses
As a result of the dispute over the Coparticipation between the Nation and the City, the ruling party will ask that some of the 12 governors
who accompanied the request for Impeachment
give testimony .
Also national officials such as the Treasury attorney,
Carlos Zannini
, the Minister of the Interior
Eduardo "Wado" De Pedro.
Regarding the
dispute over the Council of the Magistracy
, they include in their evidence the leaking of chats involving Marcelo D'Alessandro, Minister of Justice and Security of the City and
Silvio Robles
, spokesman for Rosatti.
Both will also be quoted.
The main point of the ruling party in this matter is that the Court, after declaring the 2006 Reform unconstitutional, arrogated legislative powers by putting into operation a previous law and that this cannot be done.
They are going to cite to expose the
jurists and constitutionalists
Eugenio Zaffaroni, Eduardo Barcesat and the Spanish Baltazar Garzón.
On the other hand, due to the "2x1" ruling, there are numerous witnesses.
Among them, the Secretary of Human Rights, Horacio Pietragalla;
and referents of Grandmothers and Mothers of Plaza de Mayo, CELS and HIJOS Capital.
The list is also completed, with numerous directors, secretaries, officials and employees of the Court, the forensic doctor Enzo Canonaco and the UBA teacher, Gustavo Montanini.
Testing
The Trial request will seek to collect and generate evidence.
For this, the legislators of the ruling party intend to send
requests for reports to different agencies.
Although they do not specify how they will use it, they leave the door open, giving intervention to the office in charge of wiretapping: the Directorate of Judicial Assistance in Complex Crimes and Organized Crime (Dajudeco), to "establish incoming and outgoing calls from the telephone lines that are relevant to the purposes of the investigation, as well as to report cross-calls".
The project shows that they will request a report
from the Congressional Budget Office
(OPC) that estimates the budgetary impact of the resolution for the Co-participation that disadvantaged the Nation.
They will also ask the Federal Tax Commission (CFI) for a technical report on the components that were taken into account for the transfer that then-President Mauricio Macri made to the City, led by Horacio Rodríguez Larreta in 2016.
On the other hand, in order to link D'Alessandro with Silvio Robles, the resolutions in which Robles's wife, Laura Latorre, was designated in Nation or City dependencies during macrismo governments.
