Durante la exposición de los peritos, los rugbiers fueron reconocidos en distintos momentos de la secuencia previa y posterior al ataque. Pero en la golpiza, no había sido mencionado Luciano Pertossi. Entonces, la querella pidió pasar un video, que muestra cuando le pegan a Tomás D'Alessandro, amigo de Fernando. Detrás del auto se ve pasar a una silueta de remera negra. Los peritos empezaron a descartar y sólo quedaban dos opciones: una era Pertossi.
En ese momento, Luciano levantó la mano e intervino Hugo Tomei -abogado de los rugbiers- que interrumpió la exposición: "Luciano Pertossi quiere hacer una aclaración", dijo. Pidieron sacar a los peritos y el joven se sentó en el banquillo. "Quiero hacer una aclaración", arrojó.
"Eso es hablar", le respondió la jueza. "Quiero aclarar que yo no estoy ahí, como están diciendo", contestó el joven.

Continúa la identificación de los acusados
Los peritos se basan en tres o cuatro capturas de cada "evento", como llaman al material grabado por las cámaras. A partir del reconocimiento facial y de la ropa que usaron, van identificando a los rugbiers. De esa manera, los ubican con certeza en cada lugar, pero no hablan de acciones.
El fiscal Dávila pidió que el reconocimiento no lo hicieran por número, sino que fueran nombrando por nombre y apellido a cada uno de ellos. Así, en las distintas secuencias, aparecen además de los ocho imputados, sus amigos Juan Pedro Guarino y Alejo Milanessi, que fueron desvinculados del caso, y Tomás Colazzo, un amigo que no estuvo implicado en el ataque. El primer análisis de la identificación de los rugbiers
Los peritos, licenciados en seguridad y especialistas en criminalística, comenzaron analizando las imágenes grabadas por 3 cámaras de seguridad pública instaladas sobre Avenida 3 y Avenida Buenos Aires, 2 privadas de video vigilancia de la calle Alameda y de vigilancia de Le Brique, y 3 dispositivos móviles, uno que grabó desde la vereda del boliche y dos desde la misma vereda donde atacaron a Fernando.
A partir de fotos de cada uno de los imputados, tomadas de frente y de ambos perfiles, los identificaron en los distintos videos, catalogándolos. Comenzaron por el de la salida del boliche, el de la cocina, y luego por el de la pista, que por no estar lo suficientemente claro, debieron ayudarse con otras imágenes e identificarlos por la vestimenta.

"A partir de ahí, nace la amenaza directa de Thomsen. Lo señala y lo amenaza directamente con una seña que lo iba a degollar. Una amenaza es algo muy importante. Acá Thomsen lo señaló a Fernando, le dijo te voy a matar y lo mató", advirtió el abogado de la familia de la víctima.
Además, volvió a hacer hincapié en los mensajes por celular que se mandaron los rugbiers luego del crimen: "Festejaban después de tener conocimiento de la muerte. No hay arrepentimiento. No llaman a la madre para decirle 'che, me mandé tremenda cagada'. Festejan. Hablan de hacer una previa ese día, de tomar vino y fumar flores, de llamar a una joven para tener una fiesta. Y así un sinnúmero de actitudes".

Burlando: "Hemos quintuplicado la cantidad de pruebas y contundencia"
Antes de ingresar a la novena audiencia, Fernando Burlando -abogado de la familia de Báez Sosa- analizó que hasta ahora "el balance es más que positivo".
"Durante la investigación penal preparatoria estaban probadas determinadas circunstancias que alcanzaban para arribar un fallo condenatorio. Después de este juicio, sin lugar a dudas, hemos quintuplicado la cantidad de pruebas y la contundencia de las mismas", señaló en diálogo con La Nación.

Tras las audiencia del miércoles en la que se exhibió la ropa manchada con sangre secuestrada a los rugbiers el 18 de enero de 2020, la mamá de Fernando Báez Sosa contó lo difícil que fue asistir a esa exposición durante el juicio..
"Es muy doloroso ver la sangre de mi hijo por todos lados. Se ve que le atacaron de todas maneras, destruyeron todo el cuerpo de mi hijo", expresó Graciela Sosa Osorio.

El análisis genético presentado en la jornada de ayer permitió determinar que el ADN de Fernando se halló en dos zapatillas de Máximo Thomsen (23), en una camisa floreada blanca, los jeans y una zapatilla de Matías Benicelli (23), en los jeans de Ciro Pertossi (22) y en el pantalón de gabardina de Luciano Pertossi (21), hermano del anterior. Los ocho rugbiers imputados fueron trasladados a los tribunales de Dolores, para estar presentes en la novena jornada del juicio en su contra. Como es habitual, llegaron cerca de dos horas antes del inicio de la audiencia. Se trata de Máximo Thomsen (23), Enzo Comelli (22), Matías Benicelli (23), Blas Cinalli (21), Ayrton Viollaz (23), y Luciano (21), Ciro (22) y Lucas Pertossi (23).

Reducen la cantidad de testigos

Luego de que más de 100 testigos declararan en las primeras ocho jornadas, empieza a reducirse los testimonios. Si bien inicialmente estaban pautados 14 testimonios para hoy, la mayoría de ellos no serán requeridos finalmente por los fiscales Juan Manuel Dávila y Gustavo García, ni por el particular damnificado, encabezado por los abogados Fernando Burlando y Fabián Améndola.

Los testigos de hoy: cuatro policías que declararán sobre las pericias a los videos y el reconocimiento facial
Para este jueves está prevista la declaración de cuatro efectivos de la Policía Federal Argentina (PFA), que expondrán sobre las pericias de análisis de imagen e identificación facial realizadas sobre los videos incorporados en la investigación del crimen. Se trata de Yanina Cuenca, Agostina Matticoli, Ricardo Gabriel Pisoli y Andrés Bruzzese.
Los efectivos se centrarán en el análisis detallado y cuadro por cuadro de las imágenes de video incorporadas a la causa, que fueron utilizadas para tratar de identificar a los imputados a partir del trabajo de comparación facial. Debido al volumen de material analizado, se espera una declaración en esquema de coloquio que podría extenderse por varias horas.

This Thursday the ninth hearing of the trial for the crime of Fernando Báez Sosa will take place in the Dolores courts.
In total, there are thirteen testimonial sessions planned.
The last one will be on Wednesday the 18th, on the third anniversary of the murder, when the two friends of the defendants who were dismissed in the investigation of the case could testify.
The verdict will be announced on Tuesday the 31st.
