This Monday, January 16, a bill from the Senate for universal emergency aid for victims of domestic violence is studied in the Assembly from 4 p.m.
The text of the law, on the initiative of Senator Valérie Létard, proposes to take women victims of domestic violence out of their homes by allowing them to access an emergency loan issued by the family allowance fund (CAF).
In the context of domestic violence, the victims, in an emergency situation, often leave their home without administrative documents and without money.
Many then find themselves in a precarious situation, which pushes them to have to return to the family home.
This universal
emergency aid
would allow them to take shelter, at least for a while.

To have access to this loan, several conditions have been defined in the text of the law.
A family court judge must issue a protective order for the victim.
The latter must have filed a complaint with a police station or a gendarmerie.
This can also be done “
through the reporting of health personnel to the hospital, for example, when a woman comes to have her blows noted
”, adds Valérie Létard on

The woman can be the victim of violence from a spouse, a partner or a PACS partner.
The advance granted is an interest-free loan, the amount of which is paid in three monthly installments by the family allowance fund whose district includes the applicant's domicile.
In view of the emergency situation, the payment of the first monthly payment occurs “
within three working days after receipt of the request
”, specifies the text of the law.
The victim can then repay his debt in one or more installments.
The loan is without repayment obligation for people in financial difficulty.

In its last annual report, 3919 noted an increase in violence against women: the listening number received 92,674 calls in 2021, i.e. + 14% compared to 2019. The association therefore insisted on three points in the fight against this violence: the creation of specialized courts, equipped with means, in matters of gender-based violence;
better consideration of domestic violence in decisions concerning parental authority;
the fight against the precariousness of women victims of violence, including after separation.
