If Robert Brannekämper (CSU), member of the state parliament, has his way, it won't get that far.

Together with his party colleague, the chairman of the automobile club Mobil in Germany, Michael Haberland, Brannekamper will file a lawsuit against the diesel driving ban at the Munich Administrative Court on January 31.

The font should be designed in such a way that it includes as many people as possible, i.e. both drivers who live in the central ring road and those who move outside the prohibited zone.

The main argument will probably be that the diesel decree is disproportionate.

"The air in Munich is already getting better," says Brannekamper.

In the third quarter of last year, the critical nitrogen oxide values ​​were not exceeded at any measuring point in the city.

Previously, only Tegernseer Landstraße and Landshuter Allee had exceeded the limit of 40 micrograms per cubic meter of air set at European level, albeit marginally.

Brannekämper also argues that the air quality during the lockdown hardly improved significantly when there were demonstrably fewer cars in the city.

This shows that cars do not cause the bad values ​​per se.

The diesel ban had become necessary because the German Environmental Aid (DUH) had sued and won several cases.

Initially, the Free State was responsible for complying with the limit values ​​in Munich using the so-called clean air plan.

But in mid-2021, the state government passed the responsibility on to the city.

The top of the town hall then worked out the compromise with the DUH.

Now courts have to decide again.


The critics of the ban are encouraged by their legal counsel.

Lawyer Claus-Peter Martens had already achieved success in Berlin.

A driving ban on eight sections of the route has been in effect in the federal capital since July 2019.

Martens had sued against this with two clients and was right.

In 2021, the first four driving bans were lifted by the Senate, and the rest will be lifted in the summer.
