According to the indictment, filed by the Rehovot Branch Claims Unit, the defendant and the complainant each drove their vehicle on Route 40 towards the Givat Brenner settlement intersection.

During the trip, the accused stuck with his vehicle to the complainant's vehicle until he blocked her path of travel.

Later, the accused stopped his car when a red light appeared at the traffic light, got out of the car holding a knife and stabbed the left rear tire of the complainant's car.

As a result, he was convicted of possessing a knife and deliberately attempted to acquire it.

The prosecution, in the arguments for punishment, insisted on the protected values ​​that were damaged as a result of the defendant's actions in which he protected the safety and well-being of the complainant and emphasized the intensity of the injury to her given that the background to the commission of the offense was a casual argument over the use of the road, without provocation on the part of the complainant and the defendant's use of a knife for the purpose of damaging property and fortunately , the case did not end with more serious results and also because of the need to eradicate the phenomenon of violence on the roads.

On the other hand, the defense attorney argued that the compound to which the plaintiff is petitioning, is excessively severe and does not correspond to the circumstances of the commission of the crime or the punishment policy used.

In the meantime, it is claimed that the incident was short-lived and unplanned, the knife was kept for work purposes and in a time of stress the defendant misused it, causing damage to property, but in practice the damage is not great and it is believed that the recommendation of the probation service should be adopted in full and be satisfied with an educational punishment of 180 hours for the benefit of the public and compensation to the complainant.

Judge Zohar Divon finally decided on a sentence of five months of community service, a fine of 1,000 shekels and compensation to the driver of 1,500 shekels and noted in the sentence that "the Supreme Court has repeatedly insisted on the need to fight the phenomenon of the use of violence in all its forms and shades, which will not take over all areas our lives, and the court's commitment to fight this phenomenon by imposing deterrent and significant punishments that will reflect a deterrent message to criminals and society as a whole.

"The actions of the accused deserve a real punishment that should convey to the accused and others a clear message according to which anyone who puts a heavy hand on the other person on the background of a minor matter of using the road, may pay for it with a real and tangible punishment. If I found that the law should not be exhausted with the accused, it is because of the admission of his actions and the expected harm to him," Judge Divon wrote in her decision.
