The court ruled: a heart attack because of a WhatsApp message - a work accident | Israel Today

S asked the National Insurance to recognize the heart attack as a work accident - but it was rejected • The judges who succeed in proving that a message sent by the lawyer to his client is the cause of the heart attack


The Labor Court recently ruled that it was a WhatsApp message sent by a lawyer to his client that caused him to have a heart attack, and therefore this will be recognized as a work accident.

Plaintiff S, a 50-year-old environmental consultant, through his lawyer, filed a lawsuit in the amount of 1.2 million shekels against a recycling company, alleging that it did not pay him his salary for the annual consultation he gave her for the treatment of contaminated land.

Some time later, when he saw that the lawyer was repeatedly approving the defendant's requests to postpone the deadline for submitting a statement of defense, S. was furious about this - and demanded that the lawyer no longer approve the postponement requests, and even requested that he simultaneously file a lawsuit against the company that owns the contaminated land.

In response, the lawyer sent him a WhatsApp message in which he informed him that he had ceased to represent him, and as a result S consulted with his friends in an attempt to find a replacement lawyer to continue managing the lawsuit.

However, when he realized that changing a lawyer is problematic and will cost large sums - in addition to the expensive advance he had already paid to the one who canceled his representation - mental stress developed in S, which gradually intensified to the point of chest pains with radiation to the left arm.

When the pain became unbearable, his wife called an ambulance that took him to the hospital, where S was diagnosed with a heart attack and underwent a catheterization.

When he recovered, S asked the National Insurance to recognize the heart attack as a work accident - but it was rejected, so he filed an appeal to the Labor Court, through attorney Elisher Feingersh from the Markman and Tomshin office.

In the end, an expert appointed by the court determined that there was a causal connection between the seizure and the WhatsApp message, and therefore the incident should be recognized as a work accident - which caused the National Insurance to retract and accept S's request.
