New details continue to emerge about the classified documents President Joe Biden took to his private office and his Delaware home after leaving the vice presidency.

The White House has said batches of documents have been found on four separate occasions: November 2, December 20, January 12 and January 14.


A special prosecutor has been appointed to investigate how the documents have been handled and Biden's team is cooperating and has denied any wrongdoing.

The investigation continues its course.

CNN recounts the latest developments as new data emerges.

Timeline: Biden's classified documents

  • November 2022

    November 2—President Joe Biden's personal attorneys unexpectedly discover Obama-Biden administration records at the Penn Biden Center in Washington, notifying the US National Archives and Records Administration (also known as National Archives).

    According to Biden's personal lawyer, Bob Bauer, the president's lawyers will be in regular contact with that office for the next eight days.

    November 3—The National Archives informs its inspector general about the matter.

    November 4—The inspector general of the National Archives informs the US Department of Justice that Biden aides found documents at the Penn Biden Center.

    November 9—The FBI and Justice Department begin an evaluation to determine whether classified material was mishandled.

    November 10—The Justice Department informs Biden's personal attorneys that it has initiated the evaluation.

    "Once the president's personal lawyers heard from the Justice Department, the president's personal lawyers were in regular contact with the Justice Department," according to Bauer.

    November 14—Attorney Secretary Merrick Garland asks US Attorney John Lausch to oversee the investigation of the documents.

    November 18—Garland appoints Jack Smith, a former war crimes prosecutor in The Hague, as special prosecutor to oversee investigations into former President Donald Trump, including his handling of classified material found at Mar-a-Lago.

  • December 2022

    December 20—Biden's personal lawyers inspect the garage of the president's home in Wilmington and identify a "small number" of possible classified records.

    The personal lawyers stop their search upon discovery and inform Lausch what they found.

    December 21—Biden's personal lawyers arrange for the Justice Department to take possession of the documents found in the garage of the president's home in Wilmington, and the Justice Department takes possession of them.

  • January 2023

    January 5—Lausch briefs Garland on the results of his initial investigation and advises that the appointment of a special prosecutor is warranted.

    January 9—The White House counsel's office confirms publicly for the first time that classified documents were found at the Penn Biden Center, after media reports on the find.

    January 11—Biden's personal attorneys search the president's homes in Wilmington and Rehoboth Beach for additional records.

    They locate a potential record with classified markings in a room adjacent to the garage.

    They leave it where they found it and call off their search.

    They leave Wilmington for Rehoboth, where they search Biden's house.

    No records are found in Rehoboth and the lawyers return to Washington.

    January 11—News outlets report that additional classified documents were found at a location other than the Penn Biden Center.

    January 12—The White House counsel's office confirms that a “small number” of additional classified documents were located in two locations at Biden's Wilmington home, mostly in the garage.

    They say that "a document consisting of one page" was found in a room adjacent to the garage.

    January 12—Biden's attorneys inform Lausch of what they found in the Wilmington home in the room adjacent to the garage and begin the process of arranging for it to be turned over to the Justice Department.

    White House counsel Richard Sauber travels to Wilmington to facilitate the transfer of documents, he is authorized to do so.

    As the documents are transferred, an additional five pages marked as classified are discovered.

    January 12—Garland appoints Robert Hur as special prosecutor to conduct an investigation into the matter.

    January 14—The White House counsel's office publicly discloses that an additional five pages of classified material were found in Wilmington.
