Domestic employees: how and until when can you request the refund of the end-of-year bonus

The Government promised that employers will be able to recover up to 50% of what is paid. The AFIP has already opened the registration. The requirements.


In December, by a government order, the employers of workers in private homes in a dependency relationship had to pay them a

non-remunerative bonus

.

Now, some of them can

request a refund

of up to

50%

of the amount paid, but

there is a deadline

to do so.

In the case of domestic employees who work 6 to 8 hours a day, 5 days a week, and who work without retirement, they should be paid

proportional

amount for the number of hours worked.

If the employer is subject to the payment of Income Tax, the amount will be

deductible

from that obligation.

And in the event that the employer

does not pay taxes on Earnings

Until when is there time to request a refund of 50% of the bonus and how is it requested?

Registration

Employers must complete the process on the AFIP website casasparticulares.afip.gob.ar.

What are the requirements imposed by the AFIP to be able to collect the refund?

In order to receive the return of 50% of the year-end bonus, the AFIP requires the employer to meet the following

requirements

:

1.

Not be subject

to Income Tax

up to the fourth category.

2.

Not having simultaneously a

salaried job

and an economic activity framed in the

Monotributo

with category "C" or higher, or in the

self

-employment regime .

3.

Not to be found in the Registry of Employers with

Labor Sanctions

(REPSAL).

4.

Having declared in

Personal Assets

, for the year 2021, a patrimony of less than

50 times

the amount determined as non-taxable earnings with respect to Income Tax.

5.

Not be the owner of

more than one property

, of an automobile less than one year old, or of

more than one automobile

, or of a boat or aircraft.

As announced, the Ministry of Labour, Employment and Social Security will be the body in charge of notifying employers of the news regarding the refund request, through the

electronic tax address

.

In addition, each user will be able to see the status of their request from the "

My submitted requests

" option , within the "Refund Request - Decree No. 841/22" card of the AFIP Private Houses portal.


Likewise, from the Government they warned that they will

reject

the request if they detect that

false data

was presented or that there was any breach of labor, social and pension obligations.
