– Bavaria's Minister of the Interior, Joachim Herrmann, called for more weapons controls after the major raid on the Reich Citizens' Scene in December, during which various weapons were seized.

The district offices are responsible for the controls.

There will be a new recommendation for them on how they “should deal with this topic”, Herrmann had announced.

But how is the matter currently being handled in the district?

A total of 20,825 weapons and weapon parts are currently registered between Icking and Jachenau.

Even if a person often owns several weapons, the circle of those to be controlled is quite large.

"Citizens are either sought out sporadically or checked on the basis of clues or indications of a gun law violation," explains district office spokeswoman Marlis Peischer.

All weapons would then be checked for the correctness of the weapon data, the correct number of weapons, the charge status and the basic storage regulations.

"If violations are found, they go directly to our clerk to review a revocation."

35 gun owners are to be checked every month

As a rule, the state of charge of the weapon or storage outside of the approved security container is the reason for complaints, explains Peischer.

If a violation is found during the inspection, there is a hearing procedure in which the person concerned can comment.

“If the suspicion cannot be dispelled, the citizen concerned will be given a revocation.

The latter must then hand over his weapons to an authorized person within the meaning of the Weapons Act or hand them over to the District Office for destruction.” The State Criminal Police Office takes care of the latter.

There were no objections to the storage controls last year.

Of course, that could be due to the fact that there are only exemplary gun owners in the district.

More likely, however, the small number of controls is the actual reason for this.

Because in 2022 there were only five of them.

On the one hand, weapons law belongs to the same subject area as civil protection.

This means that the employees had their hands full with the pandemic and the disaster.

On the other hand, there have been some long sick leave and staff changes in the department, explains Peischer.

This year, however, the number of controls is to be increased significantly again.

A new concept provides for at least 18 people to be checked every month, i.e. at least five per clerk.

"The weapons authority has set itself the target of 35 gun owners per month," says Peischer.

During the checks, the employees occasionally come across one or the other unusual thing.

"The strangest finding so far was that a gun owner did not store his guns properly in the gun cabinet, but kept them in his house, for example in the walls or ceilings between the insulation," says Peischer.

In the event of an inheritance: information about what to do with a weapon

Sometimes you come into possession of a weapon quite unexpectedly - through inheritance.

What do you do if you don't have permission to do it?

"In such a case, the district office must be informed that there is a weapon inheritance," says Peischer.

Then the various options would be discussed.

Even without the necessary documents, someone can “take over the weapon with the need to inherit” if they are named as heirs by the probate court – for example if you simply don’t want to part with the piece for nostalgic reasons.

The prerequisite for this, however, is that the weapon is equipped with a so-called blocking system.

This prevents loading and firing.

You shouldn't simply hang it over the fireplace as a decorative element.

"The weapon must then be properly stored in a security container," says Peischer.

If you inherit a weapon and don't want to keep it, you can hand it over to the district office for destruction.
