Continuation of the concessions for Channel 14 and the other dedicated channels: removal of regulatory obligations for another year


About a year before, the Cable and Satellite Council, headed by Dr. Yifat Ben Chai Segev, approved channel 20 (now 14) to broadcast news in its entirety - this under more lenient conditions compared to the commercial channels

The Communications Ministry is extending for another year the concessions given to Channel 14, including the removal of regulatory obligations in the form of source and source productions, as required by law.



In February 2018, the law of the Second Authority for Television and Radio (Amendment No. 44) was re-enacted, in which a transition order was established for the holder of a dedicated channel transmitter license who received a mini or mini dedicated license.

In accordance with the directive, a number of concessions will be applied to the holder of a minor license or a designated minor, in relation to the regulation applicable to license holders for television broadcasting by virtue of the law of the Second Authority for Television and Radio, and this for a fixed period of 5 years.

The purpose of the transitional provision of Amendment No. 44 was to reduce the regulation applicable to the holders of these licenses due to their having a limited scope of income or due to their public designation, as the case may be.

In practice, according to estimates, the purpose of the legislation was to benefit Channel 14 - considered to be mobilized for Netanyahu's needs, and to allow him to operate without similar barriers.

In about a month, the transition period of Amendment 44 should end. This means that the owners of the tiny and tiny dedicated licenses will be subject to regulatory duties similar to the duties that apply to major commercial channels (broadcast channels).



Today, the channels "Now 14" and "Arutz 24" have a small license as defined in the Second Authority Law and the channels "Hala TV" and "Channel 9" have a dedicated small license as defined in the Second Authority Law.

However, according to senior officials in the industry, today, against the background of the significant increase in the scope of viewing on channel 14 while sometimes even bypassing the major commercial channels, it is doubtful if this was what the original spirit of rock intended.



The Ministry of Communications states that the move was made due to an examination of the recommendations of the Folkman Committee (which was largely adopted by the previous Minister of Communications Yoaz Handel).

As I recall, the committee was appointed for the purpose of formulating recommendations to the Minister of Communications regarding the regulatory principles relevant to the field of broadcasting, given the developing trends in Israel and the world.



They also say that "until the end of the legislative procedures to regulate the field of broadcasting and in light of the importance of the existence of the channels with a tiny and tiny dedicated license, it is proposed in this bill to extend the "transition period" stipulated in section 71 of the Second Authority Law, for another year."
