The Government presented the controversial report at the UN with its attack on Justice and in defense of Cristina Kirchner: "They are seeking her proscription"

The Argentine Government presented a controversial report on Monday at a UN forum on Human Rights

in which it denounces the "lawfare"

in the country, charges against the media and the opposition and accuses the Justice of "persecuting" popular leaders.

It was within the framework of the Human Rights Council of the United Nations Organization (UN), where the member countries present the so-called

Universal Periodic Review (UPR),

in which the situation of human rights in each of the members.

It is a presentation that takes place every five years. 

It was

the turn of the Secretary for Human Rights, the Kirchnerist Horacio Pietragalla,

to speak, who traveled to Geneva to read a report of almost 30 pages, where he talks about "hate speech" on social networks and the media, and links them to the assassination attempt against Cristina Kirchner that occurred in September of last year.

There he began with a harsh speech, where he charged against the Judiciary and even mentioned the case of Milagro Sala, who considered that she was detained "arbitrarily."

"It is clear that under the excuse of investigating and punishing criminal acts, fundamental guarantees of the rule of law have been violated and continue to be violated. Because these criminal cases are promoted solely against political leaders who represent popular sectors, with the sole purpose of his political proscription," he questioned.


And he added: "While impunity is guaranteed for people linked to economic power, who have allowed or endorsed criminal indebtedness and capital flight that has conditioned the country and generated poverty and indigence in the population."

The official also maintained that "it is not by chance that human rights organizations" in Argentina "support the request for impeachment against the members of the Supreme Court of Justice" since -he argued- "the loss of credibility of the highest court implies an inadmissible degradation of the institutional system that jeopardizes the republican system of division of powers".

"For this reason, we request the accompaniment of the Human Rights Council in promoting initiatives and regulatory reforms that seek to strengthen judicial independence and the rule of law in the country," he added.

In the report presented, the Argentine Government

reviews different points on the Human Rights situation in the country, such as the processes of 'Memory, truth and justice',

advances in gender equality, the fight against sexual violence or access to The education.

It is a space that allows to debate the human rights situation of all the Member States of the United Nations.

There he receives “recommendations” from the other members of the international community on how to improve the human rights situation in the country under review.

There is no other similar mechanism at the level of the United Nations.


Almost towards the end, there is a section entitled "Emerging issues: main challenges", where the government targets the judiciary, the media and the opposition.

In the first place, he mentions the so-called hate speech, and links it to the attack suffered by Cristina Kirchner in September 2022, when Fernando Montiel Sapag shot her in the face when she arrived at her apartment.

"We must draw the attention of the Council to the so-called hate speech, and its implications for democratic coexistence and which culminated in the attempted assassination of the current Vice President of the Nation, and twice President, Cristina Fernández de Kirchner", begins the report.

Then he blames the media and the opposition for disseminating them.

"These postulates are increasingly noticed in various political spaces, in the mass media and on social networks. It is a complex problem that constitutes a concern at the international level," the text maintains.

But perhaps the most controversial point is 188, where he talks about "lawfare or" legal warfare.

"The current National Government and the human rights movement warn that the practice of lawfare - promoted by sectors of the Judiciary, the political opposition and concentrated sectors of economic and media power - constitutes a practice that violates human rights and operates as a conditioning of the electoral processes, of the political agenda and of public opinion", accuses the text

He then argues that Vice President Cristina Kirchner is a victim of these maneuvers and that the legal cases for corruption that convicted her "violate due process" and only seek to attack leaders of "popular sectors."

"In these judicial cases, such as those faced by the former President of the Nation, under the excuse of the investigation and punishment of acts of corruption, fundamental guarantees of the Rule of Law are violated. These criminal cases are promoted only against political leaders that represent popular sectors, while powerful sectors that have allowed or endorsed the criminal indebtedness that has generated poverty and indigence in the population are maintained in impunity," states the report.
