Memmingen district court: Former Marist brother convicted of sexual abuse

The trial involved a total of 19 crimes committed by three boarding school students who were 13, 15 and 17 years old at the time of the crime.

In view of the allegations, the representative of the Memmingen public prosecutor's office had requested a conviction for 18 cases of sexual abuse of children, in 15 cases in connection with rape and sexual assault.

The public prosecutor's office requested a total prison sentence of three years and six months, with an individual prison sentence of eight months for each of the three cases of sexual abuse of children and an individual prison sentence of two years for each of the 15 cases of sexual abuse of children in conjunction with rape and an individual prison sentence of one year and three months was applied for in the case of sexual assault.

Juvenile court finds former director of the Mindelheim Marist boarding school guilty

The juvenile court at the district court in Memmingen finally found the accused Marist brother and former head of the Marist boarding school in Mindelheim guilty of four counts of sexual abuse of children and sexual assault and imposed a total of one year and eight months in prison.

The execution of the total prison sentence was suspended on probation.

Individual penalties were eight months' imprisonment for each of the four cases of sexual abuse and one year and three months for sexual assault.

With regard to the charge of sexual abuse of children in 14 cases, each in combination with rape, the accused was acquitted.

In doubt for the accused

The court states that after “the taking of evidence and, in particular, the questioning of an expert on the credibility of the statements made by the witnesses concerned, the necessary conviction that the accused had committed the crimes was not achieved”.

In plain language: Based on the psychological report, the court came to the conclusion that the allegations of rape by the alleged victim cannot be proven beyond a doubt.

The defense has asked for an acquittal in 15 counts of child sexual abuse in conjunction with rape.

In view of the offenses admitted by the defendant, the imposition of an “appropriate total custodial sentence suspended on probation” was requested.

Already two convictions for abuse cases on probation

The former Frater had already been sentenced to suspended sentences twice for abuse cases more than ten years ago.

The defense of the possible rape victim announced after the verdict that they would appeal.

If this is successful, the process at the Memmingen District Court could be reopened.
