Oral Zoit's sentence will be determined today (Tuesday) after the panel of judges of the Tel Aviv District Court convicted only of manslaughter and not of murder the 26-year-old resident of Holon, who shot the late Yuri Podovni to death about 4 years ago due to an argument over parking.

The indictment against Zoyt was filed before the reform to the crimes of manslaughter, and therefore he was convicted of a crime that no longer exists - the crime of manslaughter.

According to the indictment, Zoit, together with his father and brother, ran a family business for importing industrial dishwashers to halls and restaurants, and the late Podovani worked in a store for packing and moving materials on the same street. Before the murder, which took place in February 2019, a fight broke out between the manager of the store where the deceased worked, and Zoit and his father on Habnai Street in Holon, following an argument about parking next to the two businesses.

During the fight, the defendant Zoyt, who participated in the fight, entered the business owned by his family members, took a gun from him, buried it in his clothes, and returned to the scene of the incident.

After noticing the deceased advancing towards his brother and father in an attempt to attack them, Zoyt pulled out the gun, shot and killed Podovani.

After the shooting, Zoyt fled the scene, but the police who arrived at the scene arrested him a few minutes after the incident.

Later, the gun that was removed during the shooter's escape was also located.

Judge Ra'anan Ben Yosef, who headed the panel, wrote in the verdict that "all the objective facts do not show that the intention should be used in his case. After shooting, he continued to beat the deceased."

The judge also said that "the dispute was whether the prosecution proved that when he pulled the trigger he had the intention of murder. The prosecution argued that he should be convicted of premeditated murder, while the defense argued that he should be convicted of reckless homicide.
