The crime of Lucio Dupuy: why the family asks that if there is a conviction, they separate the two defendants

Two days after the sentence (it will be known on Thursday) for the crime and the abuse suffered by the minor, the paternal family updated a claim that they had already made when the preventive detention of the mother Magdalena Espósito Valenti and the girlfriend was issued, Abigail Páez, imprisoned for Lucio's death and abuse.

Lucio Dupuy was murdered on Friday, November 26, 2021. According to the experts, they beat him to death.

His mother, Magdalena Espósito, and his girlfriend, Abigail Páez, are charged with the crimes of

aggravated homicide and outrageous sexual abuse.

They could be sentenced to life imprisonment. 

When Magdalena Espósito Valenti and Abigail Páez were arrested, during the early morning after Lucio's crime, they were housed in the Sixth Section in the Butaló neighborhood of the city.

On Sunday, November 28, there were demonstrations in General Pico and Santa Rosa.

The minor's family asks that they be separated if they are convicted.

In the Pampas capital, the protest mobilized to the Sixth Section.

First there were bricks and stones against that police station, and finally they

burned the entrance and three cars

that were nearby, including two patrol cars.

The demonstration was repressed and controlled by police forces.

Espósito Valenti and Páez were transferred that same morning

to the San Luis jail.

The Ministry of Security used an existing agreement between the provinces.

Thus, they began to serve preventive detention in San Luis Penitentiary Unit No. 1.

For this reason, from that moment on, Espósito Valenti and Páez shared that space in the prison.

This Thursday the verdict for the murder of Lucio Dupuy will be announced.

The family's claim

The lawyer José Mario Aguerrido, responding to the request of the Dupuy family, asked that they be separated.

"What they told me was that what was foreseen, as the harshest sanction at this stage (pretrial detention) is

the deprivation of liberty, not that they be separated,

" he said. 

Despite the lawyer's request, a formal request has not yet been made in the case.

The explanation is that the trial modality of the Lucio case is called “caesura”.

This means that first it will be the Court of Hearing, made up of judges Daniel Sáez Zamora and Andrés Olié, and judge Alejandra Ongaro, who will announce whether Espósito Valenti and Páez are guilty of the crimes of which they are accused.

And then, 15 days later, that same Court will announce the sentence that they must serve if they are found guilty. 

Aguerrido explained:

"Once the sentence of the sentence (guilty or innocent) is known, another instance comes, which is the request for a sentence

. "

Probably there the will of the Dupuy family is expressed that the defendants are also separated.

Silvia Gómez, Lucio's paternal grandmother, also explained the arguments for the request.

“What they wanted was to be together.

In La Pampa there is a women's prison of the Federal Penitentiary Service.

It is Women's Unit 13, which is in Santa Rosa.

They were housed there while the oral trial was held in the pampean capital.
