Cristina Kirchner wants the challenge against Judge Capuchetti to be broadcast live

Vice President Cristina Kirchner asked the Justice to broadcast live the challenge hearing against federal judge María Eugenia Capuchetti, who is investigating the case for the attempted assassination against her, which occurred on September 1, 2022 at the door of her address.

He did it through his lawyers before Judge Leopoldo Bruglia, who set the hearing for Thursday, according to sources close to the former president to the Télam agency. 

On Monday, Capuchetti rejected the last challenge presented by the vice's complaint in the case in which the attempted attack against him is being investigated, according to judicial sources.

The recusal points to a supposed impartiality of the judge.

In the letter, which was accessed by the official news agency, the Vice President's lawyers argue that "the publicity of an oral hearing like this is based on its importance and public interest."

Judge Maria Eugenia Capuchetti entered Cristina Fernández Kirchner's house in Recoleta, after the attack.

In 2019, he appealed to the same strategy and also requested that his statement be broadcast live in the trial against alleged crimes in the award of national public works in Santa Cruz to the company "Austral Construcciones" of Lázaro Báez.

On that occasion, the members of the Federal Oral Court 2 (TOF 2), Jorge Gorini, Rodrigo Giménez Uriburu and Andrés Basso, denied the request and the vice later uploaded his statement of more than three hours to social networks.

Three years later, Cristina Kirchner was unanimously sentenced to 6 years in prison, with a lifetime disqualification from holding public office. 

Now, the lawyers add that "it is not only a case that this Chamber has already referred to as institutional seriousness, but also a circumstance in which basic issues for our society are discussed, such as separation and independence of powers and the conduct that must be respected by public officials".

Likewise, they consider that "the publicity of all the hearings -but even more of those that have such importance for the citizenry-, according to the Supreme Court of Justice of the Nation, leads to an improvement of the institutional quality that the Judicial Power offers and deepens the constitutional rule of law".

That is why they request that "the hearing set for February 2 at 12 noon be held orally and publicly" and broadcast by the means that the Court deems appropriate.

On January 9, Fernández de Kirchner once again filed a request for recusal against Judge Capuchetti, who is investigating the case for the attempted assassination against her, considering that the magistrate has a "dependency" of the Ministry of Justice and Security porteño.

"Last night, a challenge was filed against Judge Capuchetti for her dependence on the CABA Ministry of Security, the same one that surrounded my house with fences and did intelligence at my home before and after the attack," the former president said on her social networks that day. .

Fernández de Kirchner had already made a request for recusal against the magistrate on November 14 of last year, based on what he considered "irregularities and arbitrariness" committed by the judge "since the first day" of the investigation into the attack that occurred at his home in Recoleta on September 1, 2022.
