On the first business day after the judicial fair, the Government deepened the confrontation with the Supreme Court in the framework of the discussion for co-participating funds that must be sent to the City.
Carlos Zannini, as Treasury attorney,
expanded the challenge of the four members of the highest court
who in December ordered the Nation to restore the funds cut from the City.
While Kirchnerism seeks to advance in Congress with the impeachment trial against the Court ministers who unanimously signed the ruling that obliges the Executive Branch to pay more co-participation funds to the Buenos Aires administration, the head of all the lawyers
insisted with new arguments
in the course of the members of the highest court to continue intervening in the claim.
"This brief expanding the presentation made on December 27, 2022, I come to challenge the President of this Court, Dr. Horacio Daniel Rosatti; and the remaining Supreme Court magistrates, Dr. Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti", maintains the letter to which
Clarín agreed.
Days after the Supreme Court ordered the Nation to begin transferring 2.95% of co-participating funds to the administration of Horacio Rodríguez Larreta, the Treasury Attorney filed
a request to revoke the precautionary measure
.
In this sense, he requested that
suspensive effect be granted to this appeal
, that it be substantiated and, in a timely manner, that the precautionary measure issued be annulled.
In conjunction with this claim, Zannini signed on behalf of the interests of the State, the recusal of the four ministers of the Court so that they stop intervening in this conflict.
It happens that
although the highest court upheld the precautionary measure
filed by the City Attorney General, in charge of Gabriel Astarloa,
the substantive discussion still remains to be resolved
: the Buenos Aires government claims that it be restored to the percentage of 3.5 % of co-participation and the
return of more than 252,000 million pesos for what they stopped receiving since September 2020
when Alberto Fernández reduced the percentage of said funds.
The National Treasury Attorney asked the members of the court to excuse themselves from continuing to intervene in the case, subsidizing their recusal;
and, in addition, filed a revocation in order to render the precautionary measure issued on 12/21/2022 without effect.”
In
the presentation this Wednesday, he expanded that claim
, referring to the role of the president of the Supreme Court due to the “
appearance of messages allegedly exchanged
with Mr. Silvio Robles;
that is to say, the same official of Dr. Rosatti's Board of Directors whose conduct motivated the previous challenge formulated in the proceedings by the state representation”, with Marcelo D'Alessandro Minister of City Security.
He also used, as incorporated evidence
, the impeachment request that he is processing in Congress and promoted by Kirchnerism
.
Zannini considered that “there is a picture of the situation of unprecedented severity;
in which the exercise of its duties by the highest Court is under severe suspicion”.
In the letter, the Treasury Attorney insisted that the Presidents of the National and Federal Chambers "should issue a lottery on the challenge to Dr. Rosatti, that this is a case that could mean a turning point in the life of the institutions of our Republic."
In the definition they adopt -Carlos Zannini remarked- " society's confidence in the impartiality, objectivity and transparency of
the Nation's
Judiciary will be at stake ."
Together, the letter points to the other members of the highest court who were also requested by the ruling party to be impeached.
He cited in this section the requirement that governors and leaders of Kirchnerism signed for the process to begin in the National Congress.
