They formalized the involuntary manslaughter charge against Alec Baldwin and he would be summoned to trial in a month

2023-02-01T10:47:53.741Z

The New Mexico prosecutor said that the actor "knew the protocols" for having participated in almost fifty films with weapons. The penalty, if convicted, would be 18 months to 5 years in prison.

Actor

Alec Baldwin was indicted Tuesday on involuntary manslaughter

for the shooting that killed a cinematographer on the set of the western movie "Rust," Halyna Hutchins.

Baldwin was holding the Colt .45 revolver during production rehearsals in October 2021 when he fired himself, seriously injuring Hutchins, who died shortly thereafter.

New Mexico's first judicial district attorney, Mary Carmack-Altwies, announced in early January that there was enough evidence to file criminal charges against the American actor.

"Today we have taken another important step to guarantee justice for Halyna Hutchins," Carmack-Altwies said Tuesday, when he formalized the accusation that will take the actor to trial.

"In New Mexico, no one is above the law, and there will be justice," added the prosecutor, in line with what the family of the victim of the incident claimed.

The person in charge of the film's weapons, Hannah Gutierrez-Reed, was also accused for the same case and with the same cover.

The prosecution will ask the defendants to appear in court within a month.

Thus,

Baldwin must appear in court, it is estimated, at the beginning of March.

If convicted, both defendants could face

up to 18 months in prison and a $5,000 fine.

Aggravated by use of weapons

could raise that sentence up to five years

, according to the US legal framework.

Baldwin, 64, repeatedly claimed that the prop crew told him the gun was not loaded before handing it over and that he did not pull the trigger.

His lawyer, Luke Nikas, said he would challenge the accusation, calling it a "terrible miscarriage of law."

Gutierrez-Reed's lawyers said prosecutors

"misunderstood the facts"

and reached "wrong conclusions."

"We will fight these charges and look forward to the jury finding Hannah not guilty," Jason Bowles and Todd Bullion said in a statement.

On the other hand, assistant director Dave Halls, who handed Baldwin the revolver on set and told him it was "cold" (movie slang for a safe weapon to use)

did not contest the negligent use charge

. of a deadly weapon.

Baldwin, one of the film's co-producers, and Gutierrez-Reed were charged with two alternate counts of manslaughter with

varying degrees of negligence

.

What the formalization of the accusation against Baldwin says

In the indictment, Carmack-Altwies listed a

number of security

lapses and claimed that Baldwin knew the protocol, having been in more than 40 movies involving firearms.

A procedure by which the gunsmith should have been present to verify that the weapon was safe and not trust the assistant director, David Halls, because "

he had no power

to authorize the use of the revolver."

In addition, the prosecutor stated that Baldwin

should have received a minimum training

of half an hour on the use of firearms, but that he did not comply with it because "most of the time

he was talking on the phone

with his family."

On the other hand, Baldwin, as producer of the film,

"should never" have allowed the hiring of Hannah Gutiérrez-Reed

because "she lacked the necessary training and experience," according to the prosecutor.

Carmack-Altwies made the charges official after 15 months of speculation about the involvement in the event on the part of Baldwin, who activated a weapon that contained live ammunition,

prohibited in filming

s.

The prosecutor assured that there are "multiple

photographs and videos

" that show him with his finger on the trigger and that he violated the first safety rule on filming: "Never point a firearm, loaded or not, at another person."

The investigation by the Santa Fe County (New Mexico, USA) sheriff's office has

not yet been able to reveal how the live ammunition got

to the filming set.
