The Supreme Court begins to analyze the presentations of the Government and the City for the co-participation

While the Government reinforced this Wednesday its judicial attack to displace the ministers of the Supreme Court of Justice from the file for the amount of the Buenos Aires co-participation,

court will begin to analyze all the presentations made after the precautionary ruling that partially agreed with the City both by the Executive Power and by the Buenos Aires Attorney General.

, in disobedience to what was ordered by the Court in December.

The judicial year begins to be organized in the Palace of Talcahuano street.

This Wednesday, the new presentations were received in relation to the debate on the percentage set by the ministers (2.95%) so that the Government would return to pay immediately as co-participation to the City, leaving behind the 1.4% that in 2020 established the president Alberto Fernández.

The writings presented by the Casa Rosada through the Treasury Attorney, Carlos Zannini, were used in part, to "buy time" as denounced by the administration of Horacio Rodríguez Larreta.

It is that

until the Court responds to all the proposals, it will not be possible to advance in what the City has requested: that the Banco Nación account be seized

and the payment of the new percentage be demanded.

The Buenos Aires government maintains that since the publication of the Court ruling in its favor,  it has

lost more than 22,000 million pesos.

The ministers of the Court must issue - firstly - on two specific aspects: the request for recusal that Zannini presented and whose arguments he expanded this Wednesday on the first legal business day of the year.

In the second instance, the proposal for revocation, that is to say:

the Government requested that the ruling of last December be annulled.

As long as the courtiers do not rule on these two issues, it will not be possible to advance in the analysis of the other documents filed by the City government.

According to judicial sources,

none of the requests presented by Zannini will prosper.

With all its members back in Buenos Aires, the Court began to organize its calendar for the first agreement of ministers this year and to determine how the different documents will circulate through the four committees to analyze them and thus resolve.L

The first face-to-face meeting It will be next Thursday, February 9.

Once the two proposals of the Executive Power are resolved, the courtiers have to give a response to the presentations made by the City.

One of them

rejects the payment methodology through bonds

The other is the complaint for non-compliance with the ruling that entails the claim for the money that should have been received since December 22.

Under this same argument

, the Buenos Aires administration will request that the Banco Nación account be seized

to guarantee the payment of the money corresponding to the 2.95% determined by the Supreme Court. 


The "background" of the theme

The underlying claim must also be resolved: what will be the final percentage that the City receives, at least until a law agreed by both parties establishes another number.

Buenos Aires demands that the original percentage established during the government of Mauricio Macri be returned to: 3.5%.

The City was the last to file a complaint for this crime and extended it on the last business day against Carlos Zannini, Attorney of the Nation's Treasury.

In said role, it was he who signed the recusal of the ministers of the Court and the request for revocation.

Horacio Rodríguez Larreta's complaint also

includes Sergio Massa as Minister of Economy,

because he signed the resolution that provided for payment through bonds.


The debate

It must be remembered that in December, unanimously, the Court issued a precautionary measure ordering that 2.95% of the co-participating funds be delivered to the City (the City requests 3.50 as a fund request). and that said transfers are made daily and automatically by the Banco de la Nación Argentina.

Consequently, it ordered the suspension of Law 27,606, which had reduced the participation of that jurisdiction.

However,

the Government continued to pay 1.4%.

This represents about 500 million pesos per day.

The City should be receiving, based on what was ordered by the Court, about 1,050 million pesos per day.

In addition, President Alberto Fernández proposed paying with 90-day bonds.

The City rejected this measure before the Court, understanding that

the Co-participation is a daily drip that all the provinces receive at the beginning of the day

, it is liquid money that is deposited in the public coffers.

In its arguments, the City said that the Ley de Coparticipación prohibits any other payment methodology.

This claim is in the hands of the Supreme Court.
