Báez Sosa's crime: the first night of the rugbiers as convicts and why they are going to open the bars little by little

None requested psychological assistance and they are in cells for two. In principle, they will be moved inside the same penalty as Melchor Romero. Prosecutor, complaint and defense, ready to appeal.

Those who walk the narrow corridors of the "Separation Area" of Melchor Romero's Alcaidía III do not finish defining whether the rugbiers convicted of the murder of Fernando Báez Sosa (18) are naive or are convinced of a story that appears to be crumbling due to the ruling of the Oral Court of Dolores.

"They still believe that Justice can consider that it was a death in a fight and that they can lower their sentence

," one of the guards who spoke with one of those who received a life sentence was surprised.

It was after arriving at pavilion 8, the same one that they occupied for almost three years in pretrial detention until the verdict on Monday, February 6, was announced.

Ayrton Viollaz and Enzo Comelli returned to cell number 6. Máximo Thomsen and Luciano Pertossi returned to the bunks in cell number 7;

Lucas Pertossi and Blas Cinalli were in number 8 and Ciro Pertossi once again shared number 9 with Matías Benicelli.

None requested psychological assistance

, a contribution that the Buenos Aires Penitentiary Service (SPB) offers to detainees who are going through situations of extreme tension, such as the hearing in which the Oral Criminal Court No. 1 of Dolores ordered life sentences for five of the defendants. and 15 years in prison for the remaining three.

The authorities of Alcaidía III evaluated that Thomsen could require some help, after the fainting that was seen on live TV, while the sentence was being read.

"It was quite an acting," one of the guards

who was able to see the boy on the first night as convicted was encouraged to evaluate.

As

Clarín

was able to find out from judicial and prison sources, the eight involved in the fatal beating of Báez Sosa will continue "for a few more days" in the same sector of the penitentiary located 20 kilometers from the center of La Plata.

It is expected that the five life sentences (Thomsen, the Pertossi, Comelli and Benicelli) will be transferred to a maximum security prison.

The progressive transition: before that final destination, the prison authorities

plan to place them in a pavilion for prisoners with "good conduct".

Elderly and detainees who are about to regain their freedom.

"It is so that they adapt," they argue from the control force.

For now, Justice has not resolved the transfers.

Meanwhile, the young people of Zárate wait their turn for the weekly visit that corresponds to them.

That regime was not modified after the reading of the ruling in Dolores.

"These kids have not seen anything.

They lived for three years in a prison bubble

. When they are transferred to a common pavilion they will have an exact dimension of what prison means," acknowledged a prison guard with years of experience.

The permanence of the eight defendants (now convicted) for Fernando's crime in a special sector of the Alcaidía had a "sanitary" objective.

Those responsible for the prison wanted to ensure that they did not have contact with inmates who could harm them.

The first days of his time at Melchor Romero were difficult.

There were hints of hostility in every move the young men made.

That is why they spent almost all the time with minimal breaks (only 4 hours a day) and on counter-shift with the rest of the prison population.

That annoyance was diluted with the passing of the months.

But

the rugbiers maintained their situation of isolation with respect to the rest of the prisoners.

Now a new stage will begin.

Meanwhile, by separate string, the deadlines for making appeals begin to run.

Hugo Tomei, the defense lawyer, and the plaintiffs from Fernando Burlando's team, told this newspaper that they will make a reservation for that instance in the next few hours.

In total, the parties have twenty days from the moment the verdict was handed down to argue their complaint, which will then be submitted to the Buenos Aires Court of Cassation.

Burlando warned that he will appeal the ruling

because he considered that three defendants "benefited" with a 15-year sentence "they must have a sentence commensurate with their activity in the crime, it is perpetual for all, as I said the first day."

A new investigation will also be opened for alleged false testimony, against Pedro Guarino and Tomás Colazo, as anticipated by the prosecutor's office.

Judges María Claudia Castro, Christian Rabaia and Emiliano Lazzari allowed the proposal to extract copies of the case and start an investigation to establish whether the two young men, who were not brought to trial and testified as witnesses, committed false testimony.

If found guilty, they can be given one month to four years in prison.
