In many cases, it is better to resolve disputes through mediation rather than in court. But how do you choose a mediator correctly and is a mediation procedure legally valid at all?

But how do you know which mediator to choose and is the procedure legally valid?

Attorney and mediator Rina Politi came to the Walla! studio to sort out the issue.

What is a mediation procedure and how is it different from a court procedure?



Unlike a court proceeding, in a mediation proceeding the parties involved take their fate in their own hands and do not leave it to the casino, that is, the court, to decide for them.

Even before the mediation procedure, it is recommended to check to see if the couple is ready for such a procedure.

"Discussion between spouses leads to the consolidation of interests into a legal document that will anchor the agreements in a paper that will be approved as a judgment," says a political attorney on the subject. "In many cases, in a mediation process, we will reach a result in a short time and with minimal expenses.

What areas can be handled through mediation?



Through a mediation procedure, all areas can be dealt with, when it comes to five main issues - divorce, ketubah, property, alimony and money.

"These issues go into one agreement that needs to be sewn up for the clients," states a political attorney.

As a mediator, I don't like that lawyers are involved in the process, but it is recommended to consult a lawyer to understand the rights."



Is a mediation procedure legally valid?



If you reach an agreement that is validated by a judgment in the family court, the road to get there does not matter.

The court will always prefer a mediation procedure that was successful on the way to an agreement, compared to a mediation procedure that failed, which actually means that the next step is a world war between the walls of the court.

The fact that a mediation procedure is conducted does not block the door to the court, but the procedure makes it possible to reach agreements that suit both parties.

From my experience, when the parties are not satisfied, it is a sign that the agreement is excellent.

As long as both parties are satisfied, the agreement is amazing.
