In the video: Advocate Yedidia in Loygrund with everything you need to know about car accidents (Editor: Gilad Mann Mannheim)
Every year hundreds of Israeli citizens are killed in traffic accidents and thousands more are injured.
What is the first thing to do in case of involvement in a car accident and who is sued?
Advocate Yedidia in Loygrund came to the Walla! studio to sort out the important issue.
If I was injured in a car accident and suffered bodily harm.
Who is being sued?
In 1975 he enacted a law called the Compensation Law for victims of road accidents.
This law excluded the whole issue of road accidents from tort law, and it states, among other things, that we have no question of liability.
"According to this law, we know that every vehicle that goes on the road today is required to have mandatory insurance, which covers the driver of the vehicle, the passengers and, God forbid, if we hit a pedestrian as well," says attorney Bluygrund. "That's why, in a car accident, we sue the mandatory insurance company."
What is the procedure in case of a traffic accident between two or more vehicles?
The mandatory insurance covers the vehicle involved in the accident. Each driver applies to his insurance company, while the pedestrian will apply to the insurance of the vehicle that hit him.
What documents are required?
If you were injured in a car accident, first of all you should go to get medical treatment.
You should call an ambulance and then, as close as possible to the time of the accident, you should go get medical treatment and state that the injury came from an accident.
On this, Attorney Bloygrund said: "It is recommended to collect documents - an appraiser's report on the damage caused to the vehicle, a police certificate, and of course an orderly and continuous medical record from the day of the accident until the time when the lawsuit is filed."
What do you do in case of a hit and run accident?
In 1975, when the same law was enacted, a public corporation called Karnit was established.
This organization provides a solution in a situation where we do not have mandatory insurance, for any reason, such as a hit-and-run accident or in cases where the driver provided incorrect information.
"In this case, we will turn to that body in a lawsuit to receive the compensation we deserve as a result of the damage we suffered in the accident," explains attorney Loygrond.
At what stage is it recommended to consult with an attorney in this field?
Attorney Loygrund summarizes: "The recommendation is to seek legal advice as close as possible to the date of the accident, and there are many reasons for this, among other things, to make sure that the correct details are collected and all physical injuries noted. Regarding the application For a lawyer whose field of practice is this, it is a broad field, like medicine.
Just as there is a family doctor and an orthopedic doctor, so are lawyers.
The priority is to go to a professional whose field of expertise."
