The Chairman of the Constitution Committee, Simcha Rothman, continues to promote the legal reform legislation, and tomorrow (Tuesday) will hold another discussion on a key section of it - the superseding clause and the cancellation of judicial review of ordinary laws of the Knesset. According to Rothman's proposal that will be discussed by the committee, the High Court of Justice no He could annul laws enacted by the Knesset, but with a full composition of all Supreme Court judges, provided that all judges agreed that the law clearly contradicts a provision enshrined in the Basic Law.



Today, two articles from the reform were approved for first reading - changing the method of electing judges so that the government and the coalition will have a majority in their selection, and canceling the Supreme Court's ability to discuss or cancel fundamental laws.

Nine Knesset members supported: Rotman (Religious Zionism), Tali Gottlieb, Hanoch Malbitsky, Moshe Saada, Ariel Kellner (Likud), Erez Malol, Yoni Misherki (Shas), Yitzhak Pindros (Torah Judaism) and Yitzhak Kreuzer (Otzma Yehudit).

Seven members of the Knesset opposed - Karin Elharer, Yoav Seglovitch (Yesh Atid), Valid El Huashla (Ream), Matan Kahana (State Camp), Yulia Malinovski (Israel Beitno), Ofer Kasif (Hadash-Ta'al) and Gilad Karib (Labour). Before the committee hearing began, members of the opposition factions chanted "I have no other country" and shouted "disgrace". Some of them prostrated themselves on the floor, jumped on the tables and even physically approached the chairman of the committee and scolded him.

After that, they were removed from the discussion.



In the meantime, Justice Minister Yariv Levin and Rothman called on opposition leader Yair Lapid and state camp leader Benny Gantz to hold talks on the legal revolution at President Yitzhak Herzog's residence.

"We call on the leaders of the opposition to start negotiations without preconditions. The time has come," the joint statement said.

"We contacted their bureaus in order to coordinate a joint meeting this evening."



Shortly after, Lapid rejected the offer and made it clear that he would come to the meeting only if the legal revolution legislation was stopped.

"The necessary condition for starting a national dialogue is an immediate halt to all legislative processes for a limited time during which the dialogue will take place mediated by the president," said Lapid.

"If Levin and Rothman agree to this, we will be happy to meet at the president's house tomorrow morning."

Levin and Rothman responded to Lapid and wrote: "We were very sorry to read the statement of the head of the opposition, from which it appears that his only desire is to stop the legislation and not to hold real negotiations. We call on every responsible member of the Knesset in the opposition to behave differently. We would be happy to meet later this evening with any party in the opposition who is interested in real negotiations ".



The revolution planned by the government includes a series of significant changes in the legal system, such as a determination that only an expanded composition of the High Court can invalidate legislation passed by the Knesset. Another step of the revolution, designed to strengthen the government's hand vis-à-vis the court, is the establishment of a superseding clause that will nullify decisions of the High Court by a majority of only 61 members of the Knesset, as well as changing the composition of the committee for the selection of judges so that it is fully controlled by the coalition.



The reform also deals with weakening the power of the legal advisers to the government, so that their position will not bind the government, and with the elimination of the reason for reasonableness, which, among other things, significantly limits the court's ability to intervene in the appointment of senior officials.
