A 49-year-old man was sitting in the dock of the Wolfratshausen District Court who walked out of a Geretsried supermarket with a full shopping trolley on July 15, 2022 – without paying for the goods with a total value of 95 euros.
Since he was on open probation for driving without a license and his criminal record had 22 convictions, imprisonment seemed almost inevitable.

Lawyer Stevan Krnjaic nevertheless pleaded for another suspended sentence and provided an explanation for his client's misconduct: "He was with a friend in the supermarket to buy meat and beer with her for a party." Since he no longer wanted to put the fresh meat back in the counter, the man from Geretsried made a fateful decision: he crept past the checkout and out of the supermarket.
An employee who knew him by name noticed this.
Nevertheless, the man escaped her.
It was easy for the alarmed police to track him down in his apartment shortly afterwards.
"All the bottles were still in the beer crate," said an official in court.
According to his own statements, the accused threw the meat in the garbage when he fled.

"How can you be so stupid?" Judge Berger commented on the events.
It was incomprehensible to him that the unemployed man had learned nothing from his many previous convictions.
The prosecutor recommended a five-month prison sentence, which Berger reduced to three months.
He could not issue a positive social prognosis for the highly indebted father of five children.
Berger's balance sheet: "We have nothing here that speaks for you."
