The Haifa District Court today (Wednesday) sentenced Khaled Jabarin, a 32-year-old man from Umm al-Fahm, to life imprisonment and payment of NIS 150,000 in compensation for the murder of the singer Shafik Kabaha about a decade ago, in 2013. Kabaha, a 53-year-old resident of Kfar Qara, died , was one of the most popular singers in Arab society.

At the hearing, the prosecution demanded a mandatory life sentence plus eight months of probation for a crime of violence that the defendant has.

The judges scheduled the hearing of arguments for the punishment for January 25.

At the request of the prosecutor, Adv. Anat Steinschneid, who managed the case with Adv. Efrat Barzani, they ordered the immediate arrest of Khaled Jabarin, and his actual arrest behind bars, until the end of the proceedings.

The court guards escorted him from the public benches to the defendants' cell and from there to the detention cells in the basement of the court, from where he was taken to prison.

"Kabaha was a symbol of the Arab sector in the world and the triangular region in particular," said a group of Kfar Kara youth for change at the time.

"This is a kind-hearted man who always gave without reckoning, this is a singer whose songs are played at almost every wedding and every event. The news of his death fell on all of us like thunder on a clear day, it hit us all in the face and made it clear to everyone beyond any doubt that we are all threatened and that this could happen to each and every one of us." .



Cabha's murder is solved in a short time.

But since then, the trial has been going on for about nine years, since January 2014. Back in September 2015, by the decision of Judge Yitzhak Amit in the Supreme Court, Khaled Jabarin was released to house arrest and the sentencing committee held 113 meetings.

"This result of a heavy delay in the process is not appropriate and we regret it," the judges stated at the beginning of the verdict.

The whole story began even before the murder.

In July 2012, the henna party and the wedding of Zaki Jabarin, the brother of the accused in the murder, took place.

For one of the events, the singer Shafik was invited to perform, but he was unable to attend after a previous commitment.

According to the indictment, his lack of responsiveness angered Khaled Jabarin and his family.



After Khaled Jabarin and his friend Amal Mahamid found out about the singer's performance on October 22, 2013 at the event held at the "Al Waha" event garden in Umm Al-Fahm, they decided to murder him.

Muhammad Mahamid known as "Abu Saad" who worked in a shop selling scooters arranged for the two to get a scooter.

After the performance ended, close to midnight, Shafik left the event garden in an Opel Corsa vehicle, Khaled and Amal also left the place riding the scooter and drove ahead of the vehicle.



The two waited on the side of the road until the vehicle passed them and drove after it.

When they arrived at the police square in Umm al-Fahm, they overtook the vehicle on the right and stuck with the scooter to the right part of the vehicle, near Shafik's seat.

Khaled fired with the weapon at the singer who died from this shot.

He could not appear at the event and was murdered.

Three men were arrested on suspicion of involvement in the murder.

Amal Mahamid, incriminated Jabarin in his confession to the police.

He stated that he was driving a scooter on which he mounted Jabarin and shot Shafik.

He also incriminated the third man, "Abu Saad" and said that together with him he changed the scooter's identification plates before the murder, when Jabarin was also present.



The indictment attributed to Mahamid the offenses of conspiracy to commit a crime, murder and possessing and carrying a weapon.

"Abu Saad" was charged with the crime of aiding and abetting murder.

The criminal proceedings of the two were conducted separately and in a court decision from January 2017, Amal was also convicted of manslaughter and other offenses and was sentenced to 14 years in prison.

The conditions for convicting Amal of murder were not met and he was convicted of murder only.

In October 2015, the prosecutors on behalf of the Haifa district attorney's office almost closed a deal with Jabarin's defense attorney, attorney Moshe Sherman. Jabarin was supposed to confess to the murder, and receive an actual prison sentence of 14-16 years, but Shafik's family opposed it



. In 2017, after the conviction of the other two accomplices whose conviction indicated that Jabarin was the one who shot, the prosecution made another attempt to make a deal. The family again refused to agree and appealed to the Supreme Court claiming that the existing evidentiary infrastructure against Jabarin does not justify reaching a plea agreement for the crime of manslaughter. In addition, they claimed that the criminal proceedings in his case were not conducted properly, among other things due to the cancellation of meetings at the request of the parties, and that the family members were not given an opportunity to voice their position regarding the proposed plea arrangement, as victims of a crime.



According to them, the plea arrangement did not shock the seriousness of the incident, which expresses severe violence.

It serves to convey a lightening message regarding the illegal use of weapons and its devastating consequences.

It is further argued that Amal's conviction for murder alone does not justify a change in the state's position regarding Jabarin, since according to the prosecution, Jabarin did not share with Amal his intention to kill the late singer.



In 2018, the judges of the High Court rejected the petition, the road to the deal was paved, but by then Jabarin had already withdrawn his willingness to the deal. The trial has already continued for another five years, and even after today's dramatic decision, it is still not over.



Marie, the sister of the late Shafik Kabaha who was present when the verdict was read, expressed her satisfaction with the conviction and told Walla: "After nine years, today for the first time I feel that we are on the road to justice. My beloved brother will not be given his life back, but today he was given back a little of what he deserves after this terrible and terrible murder In cold blood over a meaningless matter. There is and cannot be any explanation or justification for such a thing and my family will bear the damages and pain forever and I especially because he was very close to me like a twin at home and at work because I was the manager of his band."
