Munich/Berlin – The new property tax has repeatedly caused heated discussions in recent months.

First the forms for the property tax return caused problems, now the tax offices are threatened with a wave of objections.

After all, anyone who discovers an error in one of the notifications within the four-week period should definitely file an objection.

The same applies if the assessed values ​​for, for example, standard land value, rental value or living space are considered unlawful, advises the Association of Taxpayers (BdSt).

So if you want to lodge an objection to the property tax assessment and/or the property tax assessment, you must do so as quickly as possible.

If the deadline is missed, the notifications become final.

Also important to know: The first objection does not have to contain a reason, this can also be submitted later.

But how do you formulate such an objection?

For this purpose, the BdSt has created the following sample letter, which property owners can use to create their own individual objection letter:

So far there is no fixed procedure for determining the standard land value.

As part of the valuation of the house/apartment, a flat-rate rent of x euros was applied.

This rent is not identical to the achievable rent or the value to be applied according to the customary local rent.

As a result, a value is taken into account that does not correspond to reality.

Property tax objection: This is the result

Such an objection then initially means that the two contested decisions do not become legally binding.

According to the taxpayers' association, they will nevertheless become the basis for the final property tax assessment in 2025.

"It can be assumed that the tax office will reject the objection after a hearing," writes the BdSt.

Then all that remains is the complaint before the tax court.

Important to know: There is no charge for opposition proceedings.

It could only get expensive if you consult a tax consultant or a lawyer.

A lawsuit would also involve costs.
