Were you injured at your workplace?

Did something happen to you on the way to work?

Apparently this is a work accident.

Who do you report to when you are involved in such an accident and what is the amount of the financial compensation?

Advocate Yedidia in Loygrund brings all the details in the studio and voila!

What is the definition of a work accident?

Section 79 of the National Insurance Law explains what occupational accidents are and what the definition is in the law.

This is an event that happens to a person during work and as a result of work, and to this is also added an accident on the way to work or on the way back from work, provided that we did not deviate from the road.

"Sometimes there are cases when we deviate from our normal way to work, if for example I was shopping on the way to work. If it is a regular routine - for example, if I drop the children off at kindergarten on the way to work every day, and on the way I was involved in an accident, there is a chance that it will also be considered a work accident." , says attorney at Loygrund.

What should I do if I was involved in a work accident?

The first thing to do is get medical attention.

Attorney Bluygrund explains: "When approaching to receive medical treatment, whether it is the EMS that arrived at the scene or the hospital we arrived at, it is important to state the facts, what exactly happened in the accident. It is important to state them because the initial data will help prove to the National Insurance that work did happen as part of the job".

Who should I report the accident to?

"The initial report is to the medical staff, both so that they know how to treat and so that everything is documented," explains attorney Loygrund. "The second thing that needs to be done is to report to the employer, if it is an employee who is an employee." What do you do if the employer raises difficulties

?

There are few cases where employers refuse to sign for various reasons.

In practice, the lawsuit is generally against social security, while the employer only serves as an aid to prove that it is indeed a work accident.

"In these situations, I recommend attaching the payslips to the lawsuit," argues attorney Loygrund. "An attorney handling the case will state in the application to the National Insurance that the employer, for one reason or another, refused to sign and in this case the National Insurance will contact the employer directly."

If I was recognized as injured in a work accident, how do I know how much money I am entitled to?

A claim in the National Insurance is divided into two parts.

The first part - a claim for recognition, and after the accident is recognized as a work accident, the second step is to go to be examined by a medical committee that will determine the damage caused to us, whether it is short-term damage or permanent damage, caused as a result of the accident.

How do you prepare for the medical board?

This is an examination by a doctor or doctors who are supposed to check, according to the relevant regulations, the intensity of the injury and what damage was caused as a result.

Attorney Bluygrund points out: "It is recommended to come to the committee with representation together with an attorney whose field of activity, he also briefs the victim on how to conduct himself in the committee and what to emphasize and will accompany him all the way."

How important is it to contact a lawyer whose field of practice is already at the beginning of the process?

"Recently, we see countless companies dealing with everything related to the exercise of medical rights, but you have to understand that this representation is not legal representation," concludes Attorney Loygrund.

If that victim needs a lawyer to come with him to the committee, he can only do so with a lawyer.

The rights extraction companies are not authorized to represent legal representation or in the medical committees.

That's why it's better to leave the handling of work accidents in one place, with a lawyer, and not spread out and go to several places."
