Two LGBT+ associations are suing Dora Moutot for transphobia

2023-02-23T15:56:13.276Z

A complaint with civil action was filed against the feminist, Wednesday, February 15, after several statements deemed offensive and "calling for transphobic hatred".

Lawyer at the Paris bar Étienne Dehouslières, specializing in press law, will represent the LGBT+ associations "

Mousse

" and "

Stop homophobia

", in the defense of journalist Hanneli Escurier and Marie Cau, mayor of Tilloy-les-Marchiennes .

On Wednesday February 15, the latter filed a complaint against Dora Moutot, blogger and creator of feminist content on Instagram.

The complainants denounce repeated “ transphobic

” remarks

, which would constitute an attack on people all the more serious as they occur, according to them, in a society “

still largely transphobic

”.

We read in the complaint that “

the discriminatory insult strikes its addressee, because it reminds him of the rejection of which it is the object within society.

The more current and present this rejection is in society, the more force the insult will have to hurt its addressee.

Two separate charges

Two separate events are involved.

The first dates from August 25, 2022. On Instagram, Dora Moutot publishes a text and photos in which she evokes statements by Hanneli Escurier, whom she describes as "a trans-identified

woman

", while he defines himself as a male.

She declares that

“these people are sick people, who use techniques worthy of the worst authoritarianism

”.

The feminist reacts to a text published on the same network by Hanneli Escurier, in which he maintains: “

One day very soon, I think, trans people will go and smash TERFS (

Trans Exclusionary Radical Feminist: expression which designates activists who exclude trans women of feminist struggles, Editor's note)

That's how it's going to end (...) It's not a call for violence, just a public premonition about something that will become inevitable.

»

The post, which has since been deleted by Instagram, is contained in the complaint file.

The two expressions of Dora Moutot, "

possibly aroused by the provocation of Hanneli Escurier

", believes the lawyer Étienne Deshoulières, are for him "

essentially offensive and characterized by a context, which is undeniably transphobic

".

“Symbolic and psychological” roles of the trial

The second part of the complaint, consulted by L

e Figaro

, concerns the comments made by Dora Moutot on the set of the program

Quelle époque!

broadcast by France 2 on October 15.

To Léa Salamé's question: “

For you, Marie Cau is a woman?

she replies: “

No, Marie Cau is a transfeminine male

”.

An affirmation which, for the lawyer Étienne Deshoulières, “

denies the existence of Marie Cau as a transgender woman, reminding her that, in the eyes of society, she remains a man, a man marked by the stigma of transgender identity. .

The substance of the accusation is there, for the specialist in press law.

"

This is what trans people find most violent: it calls into question the very possibility of their existence, and thereby undermines their dignity.

For Dora Moutot, who supports a total identity between sex and gender, transgender people do not exist.

The complaint marks a new stage in the struggle of the trans movement.

She has, according to the lawyer, “

an obviously symbolic role, but also a psychological role

”.

Bringing the remarks of a relatively well-known feminist to justice amounts, according to him, to assuring trans people of "

the force of the law

" in their regard: "

It is important for trans people who can say to themselves 'we have the law with us'', and psychologically it feels good.

He says that his firm has received a large number of thank you messages from people who said they had "

been waiting a long time for this

".

Contacted by

Le Figaro

, Dora Moutot did not wish to comment on the facts.
