Bus driver convicted of emergency braking in Päh - children were injured

Pähl – Was the emergency braking that the 62-year-old bus driver made with a school bus about a year ago, which caused the school children to suffer minor bruises and pain, justified or unnecessary?

This question had to be clarified recently in the hearing before the Weilheim District Court.

The defense defended himself against the allegations right at the beginning of the proceedings and noted that shortly before the incident, his client was already involved in a minor accident through no fault of his own, in which the left exterior mirror of his bus was severed by an oncoming truck.

"You can't see anything without a mirror," said the accused.

He actually didn't want to continue like this, but was asked to at least take the children to school.

The bus driver didn't really want to continue

As two primary school children who were called as witnesses and accompanied by their parents testified, an incident occurred on the journey between Pähl and Herrsching in the spring of last year.

According to a young witness, the bus driver suddenly braked hard without any reason or warning, causing him to hit his head on the driver's cab in front of him.

When looking outside, he could only see cars that were far away, but none in the immediate vicinity.

However, the second witness, a little girl, claimed to have heard the bus driver announce the emergency stop.

After some children ran around on the bus, the 62-year-old asked them, slightly annoyed, to sit down because it was dangerous.

Shortly thereafter there was an emergency stop.

The prosecutor saw the accusation as confirmed and assumed that the minor differences in the children's statements would result from different age-related perceptions.

The defense attorney disagreed.

It is "doubtful whether the children can judge the traffic situation correctly".

If he had actually braked hard, a lot more would have happened due to the relatively full bus, he said.

The statements of the witnesses did not convince him.

The fact that his client is already suffering from prejudice is punishment enough.

Towards the end, the 62-year-old explained that he was always very careful, watched out for the children and would never brake for no reason.

In the eyes of Judge Resch, the children's statements were "different, but not contradictory", which is why she finally imposed a fine on the man.

The verdict is not yet legally binding.
