The 60-year-old man who is accused of having a gangster background is suspected of raping a waitress in a restaurant three years ago when she was "soft-handed" because she was suspected of smelling marijuana, and sent her home.
He was later charged with one count of rape. The case was tried in the High Court today (27th). The prosecution accused the victim and the defendant of being a waiter and regular customer. The victim "grabbed and tinned", and the victim did not dare to resist because he was afraid of offending the defendant.
Defendant Jiang Weimin (61 years old) was accused of raping X in Hong Kong on April 15, 2020.
The prosecution plan stated that the victim X was working in a restaurant at the time of the case, and the defendant was a regular customer of the restaurant. The two met through the introduction of X's colleague, who revealed that the defendant suspected of having a gang background.
The defendant would chat with X when he visited the restaurant on weekdays.
The two then exchanged phone calls and chatted through messages.

Defendant said after arrest that X had consensual sex
On April 9, 2020, the owner of the restaurant saw that the business was flat, so he asked X to leave work first.
The defendant who had eaten at the restaurant then took X to a gambling stall. The defendant hugged and touched X's face, and even claimed that he wanted to open a gambling stall for X to manage.
X did not dare to resist because she was afraid of offending the defendant, and only said that the defendant should not be impatient and give her a little more time.
Two days later, the two had breakfast together, the defendant insisted on sending X home, and "hugged and tinned" X, X refused and pushed the defendant away.
On the evening of April 14, 2020, some regular customers celebrated their birthdays at the restaurant involved.
X smelled a strange smell at the scene, suspected to be marijuana, and then she felt unwell.
In the early morning of the next day, the defendant then took a taxi to send X home when X refused, and then raped X in the unit.
X tried to struggle at that time, but his hands were limp. In the end, it was unclear whether the defendant had ejaculated.
The next day, X woke up and told her boyfriend about the incident, and the boyfriend said that if she didn't want to, he would call the police.
The defendant was later arrested and admitted under caution that he had had sexual intercourse with X, but claimed that X was consensual.
