A young man stunned in 2019 by an LBD shot (defence bullet launcher) from a police officer in Mantes-la-Jolie (Yvelines) asked the Paris court on Tuesday to oblige the State to pay him 30,000 euros in damages.
In this case, Amadou N. was initially sentenced to three years in prison, including six months suspended in December 2019, accused of having participated in an ambush against the police in the sensitive district of Val Fourré, in the night of October 24, 2019.
The student had proclaimed his innocence
During this urban violence, the young man, then 19 years old, had received, while returning home, an LBD shot in the right eye, which he has since lost the use of.
Claiming his innocence, he was finally released in November 2020 by the Versailles Court of Appeal.
After a request for compensation in the amount of 30,000 euros rejected in 2022 by the direction of the judicial services, he summoned the legal agent of the State before the judge in chambers to "obtain a medical expertise and a provision to be asserted
on his prejudice
", according to the summons filed by his lawyer, Me Matthieu Chirez.
The hearing, which took place Tuesday morning at the Paris court, mainly revolved around the involvement of Amadou N. and his status as a "
third party
" in this police operation.

", third parties, had estimated the management of judicial services.
However, his lawyer recalls in his summons, “
Amadou N. is necessarily a third party to this police operation
”, because of his innocence established by his release.

In his conclusions, the State judicial officer considered for his part that there was "
a real doubt about the possibility of considering Mr. Amadou N. as a third party to the police operation, even if he was not not targeted by the initial operation
", in particular because of the criminal proceedings against him, even if the latter resulted, in the end, in an acquittal.

It must be emphasized that the applicant behaved recklessly
", passing through the street where the clashes took place, also believes the State, which notes that the applicant "
took a risk
".
Judgment will be delivered on March 28.
In this case, Amadou N., now 23 years old, was also compensated up to 12,000 euros for having spent 81 days, unjustifiably since he was released, in pre-trial detention.
