Intra-family violence: the “good practices” of the Nantes court could become a school

Charged by the government with carrying out an information mission on the judicial treatment of domestic violence, two elected officials spoke of wanting to draw inspiration from systems already in place at the Nantes court as part of an on-site visit.

The Nantes court was in the spotlight on Tuesday.

While at the National Assembly, the Keeper of the Seals, Éric Dupond-Moretti announced the arrival of six new magistrates in 2023, the two rapporteurs of the parliamentary mission on the judicial treatment of domestic violence - Senator UDI Dominique Vérien and Renaissance MNA Émilie Chandler - spent the day there as part of the hearings relating to their work in progress.

The duo has already produced a first progress report at the end of January.

New proposals are to be announced by Élisabeth Borne, the Prime Minister, on March 8 on the occasion of International Women's Rights Day, ahead of the presentation of a more comprehensive equality plan next spring.

In this perspective, the two elected officials therefore continue their meetings and analyzes of the strengths and weaknesses of the French judicial system in this area.

In Nantes, it was more a question of positive points.

A “new” approach to domestic violence

During their visit to the Nantes court, the two elected officials made a progress report on the progress of their mission.

They announced that they had conducted more than 300 hearings with the police, magistrates, associations or the medical profession.

They also went to Spain, a country which has created a specialized court on the subject.

"The idea is not to be limited to the angle of the offense but to take into account the entire family context"

Two schemes: Copilvif and Comovif

During their interventions, they notably referred to two devices already existing at the Nantes court.

The first was launched in November 2021. Its name: the Steering Committee for Domestic Violence (Copilvif).

This body, managed by the Public Prosecutor's Office prior to legal action, allows information to be circulated between the various actors in a case.

In Nantes, each month,

“ten to fifteen files”

are discussed in this context.

The objective is to allow both an informed decision with regard to the sanction of the perpetrators of the offense but also the protection of the victims whether they are adults or minors.

The second device is more recent.

Named Comovif, it has existed since July 2022. It allows information to be shared when an offender sentenced to prison is released.

It aims on the one hand to prevent recidivism and on the other to develop, if necessary, protective measures for the victim.

The role of the family division of the Nantes court, launched in 2022, was also highlighted by the two parliamentarians, in particular with the recruitment of a project manager and a legal assistant who are dedicated to cases of domestic violence.

The question of means

The Nantes court, seen as a

"voluntary"

actor on the subject, could therefore serve as an example on certain points.

“We must define a public policy that is not based solely on goodwill or local partnerships.

The objective is to achieve similar judicial treatment from one department to another

, ”said Dominique Vérien.

The stakes are high.

Currently in France, one in four cases judged by the courts concerns domestic violence.

However, these are often complex.

"Files of domestic violence handled by the police or the gendarmerie take much longer than others because we are in the human

," said the senator.

In response, the two elected officials plead for a reinforcement of the justice and security personnel dedicated to this task.

Not to mention, an increase in subsidies allocated to associations.

"The observation is that a commitment is needed at all levels: the medical profession, the police, the magistrates... For each of them, there are needs in terms of human resources and financial means. “
