“All States must condemn surrogacy and adopt measures to combat it”

TRIBUNE - In Casablanca, lawyers, doctors and psychologists of 75 nationalities will sign a declaration asking States to ban surrogacy. Le Figaro publishes their text exclusively.


Here is the text of the Casablanca Declaration for the universal abolition of surrogacy, which will be signed on Friday February 3 by a hundred researchers and practitioners from all over the world.

We, the signatories of this Statement,

Conscious

  • of the suffering of people who cannot procreate

  • the appeal of reproductive technologies

  • and the international challenge of effective protection of human dignity

Convinced

that the contract by which one or more sponsors agree with a woman that she will bear a child or several children with a view to their delivery at birth, whatever its name and its terms and hereinafter referred to as surrogacy ( GPA),

  • undermines human dignity

  • and contributes to the commodification of women and children

Ask

States to condemn surrogacy in all its modalities and in all its forms, whether remunerated or not, and to adopt measures to combat this practice.

To this end, we address the following recommendations to States:

  • prohibit surrogacy on their territory

  • refuse any legal value to contracts involving the commitment for a woman to bear and deliver a child

  • sanction the persons, natural or legal, who offer themselves as intermediaries**** between the surrogate mothers** and the sponsors***

  • sanction people who resort to surrogacy on their territory

  • sanction their nationals who resort to surrogacy outside their territory

  • work towards the adoption of an international legal instrument bringing about the universal abolition of surrogacy.

We propose

as an appendix to this Declaration a draft international Convention at the free disposal of States wishing to engage in this process.

*Gestation for others or procreation for others, surrogate motherhood, reproductive exploitation, recourse to a surrogate mother, is the fact for one or more sponsors to agree with a woman that she will bear a child or several children with a view to their delivery. at birth, whether the agreement is agreed directly between them or through one or more third parties.

**Gestator, or surrogate mother or surrogate mother: woman who agrees to one or more sponsors to carry on their behalf one or more children that she will give them at birth.

***Sponsor(s): the person or persons, also designated as clients or intended parents, who agree with a woman that she will carry on their behalf one or more children whom she will give them at birth.

****Intermediaries with a view to surrogacy: natural or legal person(s) who put a woman in contact with one or more sponsors so that she bears one or more children that she will give them at birth, and/or mediate between the woman and the sponsor(s) for this purpose.
