Warngauer (26) admits rape - and narrowly escapes a prison sentence

– The act took place at the end of May on the sidelines of the Burschenfest in Oberwarngau, one of the first major marquee events in the region after the Corona break.

According to the indictment, the victim, who is now 20 years old, attended the party with her sister.

In the course of the evening she left the tent and went outside, where she stayed next to a hut.

There the defendant is said to have addressed her with the words "You're a very pretty one".

After a short conversation, the young woman said goodbye to look for her sister.

According to the indictment, the Warngauer prevented her from hugging her against her will and tried to kiss her.

When the woman, who had been sitting on the ground, wanted to get up, the man gave her his hand, but then picked her up and carried her to a nearby parking lot, where he placed her on the hood of a car and is said to have become more and more intrusive – although the woman kept telling him to let her go.

After further kisses and touches on the neck, he is said to have reached under the blouse of the young woman and undressed and touched her upper body.

He is said to have dismissed the victim's defense several times with a simple "It's okay".

After forcing her to touch him privately, the 26-year-old is said to have used his right hand to perform acts on the woman that constitute rape.

At the request of the defense counsel, the taking of evidence took place behind closed doors.

As a result of a legal hearing, the defendant was offered a reduced sentence in the event of a confession and an apology and payment of damages.

Defense attorney Max-Josef Hösl stated that his client would make a confession and would also formally apologize for his actions.

The lawyer handed over the required 2,000 euros in compensation for pain and suffering in cash.

After the pleadings had also been held in a closed session, the judgment of the lay judge fell.

The accused was found guilty and sentenced to a suspended sentence of one year and eleven months.

Prison sentences can only be suspended if they are pronounced for a maximum of two years.

In addition to the compensation for pain and suffering, Warngauer has to pay a further 3,000 euros in installments of 300 euros each and reimburse the procedural costs for the 20-year-old, who acted as a joint plaintiff.

The court also ordered him to undergo sex therapy.

Judge Walter Leitner also prohibited him from attending a public event or festival for a year because "the temptations were apparently too great".

"Nothing against festivals, but they're not a self-service shop," warned Leitner.

Through his behavior, the previously blameless accused had crossed borders in a completely unacceptable way and humiliated his victim.

The Warngauer had to realize that "it doesn't work that way".

Nevertheless, he escaped an impending prison sentence by confessing, apologizing and paying damages, according to the verdict.
