The Constitution Committee will meet this morning to hold a discussion and a repeat vote (revision) on the law that reduces judicial review of ordinary laws and the superseding clause.

The bill was approved for first reading last week, but members of the Knesset from the opposition asked for another discussion before the vote on the rights that may be affected by the bill and before the committee approves the text for first reading.



According to the committee's approved version, the authority to cancel primary legislation will be limited to cases of procedural defects or to cases where "the law clearly contradicts a provision in the Basic Law, the majority required to change it or the conditions for violating it are fixed in the Basic Law."



The members of the committee asked for a reference to the consequences of the scope of the judicial review, and a possible violation of rights.

The legal consultation document authored by attorney Gur Blei states, among other things, that there is a fear that rights such as freedom of expression, the right to a fair trial, the right to equality, freedom of movement and other rights derived from the Basic Law on Human Dignity and Freedom will be harmed. , according to which discussions will be held with open doors, as well as regulations in the Knesset regarding voting procedures, the timing of the Knesset's convocation after elections, and more.

The bills are part of the legal revolution that the government is promoting in the face of widespread protest.

The revolution includes a series of significant changes in the judicial system, such as a determination that only an expanded composition of the High Court can invalidate legislation passed by the Knesset. Another step of the revolution, designed to strengthen the government's hand vis-à-vis the court, is the establishment of a superseding clause that will overturn decisions of the High Court by a majority of only 61 Knesset members, as well as changing the composition of the committee for the selection of judges so that it is fully controlled by the coalition.



The reform also deals with weakening the power of the legal advisers to the government, so that their position will not bind the government, and with the elimination of the reason for reasonableness, which, among other things, significantly limits the court's ability to intervene in the appointment of senior officials.
