"We felt as if a treasure had fallen on us, we could finally raise our heads above water," is how Y., a truck driver in his 50s, and his wife described their feelings after an unexpected "gift" that landed on them: a compensation of hundreds of thousands of shekels that they received without preparation Early due to rights due to him.

In one of the accidents, the steering wheel collided with Y's chest, and he suffered pain.

In another accident, Y. fell from his truck on a rainy day on the asphalt and severely injured his head, back and hand."



One of the problems was that he was completely unaware of his rights and did not understand that he deserved compensation.

"He thought he was to blame for the accidents, so he didn't bother to claim what he deserved," says attorney Ben Yosef. "We explained to him that because these were bodily injuries caused by car accidents, the question of guilt is irrelevant, and in any case he deserves compensation." Except for



lawsuits submitted on behalf of Y. regarding the disability and loss of work ability components in the insurance policies, Attorney Ben Yosef demanded on Y.'s behalf to also recognize him as a work accident victim in the National Insurance.



"Y's accidents caused him serious functional problems," says Attorney Ben Yosef. "He had difficulty driving and performing daily activities, and his quality of life was greatly affected.

We contacted the National Insurance Institute, as well as the private insurance companies and the insurance companies that insured the truck with mandatory insurance.

It was a race against time."



"A lifeline in the 90th minute"



In total, the compensation Y received for all the injuries amounted to hundreds of thousands of shekels.

"The point is that he didn't think about money at all," recalls Attorney Ben Yosef. "His wife was shocked.

She said that they really needed the money, after a period in which she also did not work.

According to Attorney Ben Yosef, "What can be learned from the case is that people deserve much more rights than they think. Many times people blame themselves for being responsible for certain events, but that has nothing to do with what really happened They deserve it. They are only losing precious time and risk losing the compensation."



The lesson from the case is "don't hesitate, and when you have a medical event, always go to a lawyer and check if you deserve rights. Do not neglect the treatment



An important tip is not to neglect the treatment.

"Part of the point is to go to the doctor at the first opportunity when something happens, describe to him all the areas of injury and pain and make sure he writes down whether it is a car accident and/or a work accident," says Attorney Ben Yosef. "Courts and insurance companies attach great importance to the earliest version of the victim in the medical record, the one that was given as close as possible to the time of the incident."



According to him, "the initial report is the most significant evidence that will lead the case, therefore I recommend that the victims immediately go to the emergency room or call an ambulance after the incident.

And this, even if the injury is not significant at this stage, since many times the pain and movement restrictions appear only a few days later.



"It is important to understand," continues Attorney Ben Yosef, "that anything that is not recorded during the initial medical treatment may be as if it does not exist in terms of the case, or it will be very difficult to prove it at a later stage.

A person can be injured by a variety of injuries, but in practice if the doctor does not record it in the summary or the victim does not tell about it in sufficient detail - it is as if it did not happen.

It will be very difficult to correct the disfigurement in retrospect, so it is important to be careful about it."
