Attorney Michael Ben Yosef, who specializes in tort law and national insurance, came to the Walla! studio to explain the issue in detail.

Who is entitled to receive compensation in the event of a car accident?

The law regulates the right to receive compensation for a traffic accident victim in cases of bodily injury.

First, the one who is entitled to receive the compensation is the driver, who sues his mandatory insurance company.

In addition, if they were traveling in a car, each passenger is entitled to sue the insurance company of the vehicle in which he was traveling.

If there were victims who were pedestrians, they are also entitled to file a claim against the compulsory insurance company of the offending vehicle.

What is the law in the case where the victim is the one to blame for the accident?

There is a difference between personal injury and property damage.

"In cases of bodily harm, the question of guilt is irrelevant," explains Attorney Ben Yosef. "In other words, even a person who is guilty of a car accident will be entitled to compensation for bodily injury.

Moreover, even if it is a self-inflicted accident, if, for example, a person collided with a tree, he will be entitled to compensation for his bodily injuries from the insurance company that insures him with mandatory insurance."

What documents must be presented in order to submit the claim?

Attorney Ben Yosef points out: "First, medical documents describing the incident and the extent of the victim's bodily injuries.

Another thing, you need a valid driver's license, a valid car license and a valid mandatory insurance policy.

In addition, a police permit must be submitted and this can be done online today.

This gives validity and backing to the very fact that the accident happened."

Should I add documentation such as pictures?

By and large, there is no need, since in the case of a car accident, when it comes to bodily harm, the question of blame has no meaning.

"If there are witnesses in case the case gets complicated, that's great, and the same goes for photos of bodily injuries," says attorney Ben Yosef.

Can a car accident also be considered a work accident?

An accident that occurred while working, on the way to or from work, can be considered a car accident which is also an accident at work. Attorney Ben Yosef explains: "In these cases, you must inform the employer that you have been in a car accident as part of the work and ask that he produce a signed and verified form 250. With this form, you apply to the health insurance fund and open a case for the injured at work. After that, you submit a claim to the National Insurance for recognition of the accident The roads as a work accident and a request for injury compensation.

What compensation can be received from the National Insurance in cases of a car accident that is also a work accident?

"First of all, you receive injury compensation," notes Attorney Ben Yosef. "You can receive up to 91 such days cumulatively, and after a person has served the quota of these days, a claim can be filed to determine the degree of disability.

Invite that person to a medical committee that will determine the extent of his disability and from this all the rights he will receive from the National Insurance will be derived."

Should you go to the committee accompanied by a lawyer?

"It is recommended not to go to these committees alone and not to submit the claims to the National Insurance alone, since the version that is submitted to the National Insurance will be accompanied You will be the same person later on," concludes Attorney Ben Yosef.

"Therefore, it should be done in an orderly and clear manner. Representation in the National Insurance is important and I recommend seeking legal advice in the initial stages."
