The legal advisor to the government Gali Beharev-Miara expressed opposition to the bill granting immunity to soldiers and police officers this morning (Sunday), which will be discussed today in the ministerial committee for legislative affairs.
"Immunity as it is proposed fundamentally changes the point of balance and thereby results in a violation of human rights and vital interests. The bill is not the appropriate tool for safeguarding these vital interests," the consultant wrote.
MK Zvika Fogel's (Otzma Yehudit) proposal, which is part of the coalition agreement, states that soldiers, policemen, Shin Bet personnel, the Knesset Guard and volunteers in the national civilian service will not bear criminal responsibility, will not be investigated as suspects and will be immune from any legal action due to an action that they carried out or an order they gave in the course of fulfilling their duties in order to delay or prevent the commission of an act of terrorism.

According to MK Vogel's proposal, the immunity will be extended to members of the security forces even after their employment, service or volunteering has ended, but nevertheless a committee will be established with the authority to remove the immunity despite the law, if the action, for example, was done maliciously
. A situation in which a member of the security forces who finishes performing his duties in an operational incident or a terrorist incident, is led in handcuffs from the scene of the incident.
