Adv. Nir Turgeman (Editor: Ziv Steiner)
How do you know if a car accident on the way to work is defined as a work accident and who should I contact if I was involved in such an accident?
Attorney Nir Turgeman from the Turgeman & Co. law firm came to the Walla! studio to explain the issue in detail.
What is the definition of a work accident and in which cases is the employee entitled to compensation?
There are a wide variety of work accidents.
The requirement of the section usually refers to an accident caused due to and while working.
Attorney Turgeman commented on this: "At our firm, we deal in many cases with accidents of people who work in manual labor - porters, electricians and more.
A work accident can also occur in different cases, such as an argument that led to a heart attack.
The goal was to prove that the
accident was caused by the
fact
.
First, everything must be documented, because the burden of proof is on the employee.
You should keep the evidence, take the names of the witnesses and their details, and photograph the hazard if there was one.
"It is also important to share with the employer and document the sharing," explains attorney Turgeman, attorney for work accident victims.
"Further on, that employee must obtain a document called BL 250, with which you can go to the National Insurance Institute and claim that we had a work accident. The employer must sign it and confirm his employee's version."
Can a car accident on the way to or from work also be considered a work accident?
"Definitely, but there are specific conditions," adds attorney Turgeman. "The National Insurance Institute is looking for the natural path of that employee, and it is necessary to prove that the accident ended during this path." What can be done if the
employer denies that I had an accident?
If the employer decides to deny and not cooperate, this will make it difficult for that employee, since cooperation from the employer is usually required.
"Even in these cases, this is not the end of the story," notes Attorney Turgeman. "It is important to document everything and contact a skilled law firm for representation in the National Insurance, to explain the situation and in many cases the employer is required to investigate to understand why he refuses to cooperate."
If my salary is damaged as a result of a work accident?
To this, Attorney Turgeman said: "There is a regulation called Regulation 15, which deals with a decrease in income. If I had a work accident and as a result of it my position was changed and the salary decreased, this is where that regulation comes into play. In these
cases
, the National Insurance Institute will increase the disability percentages set for me, and thus the compensation will be higher."
