A shared initiative referendum submitted to the Constitutional Council on Monday

2023-03-20T20:44:50.193Z

The Elders now have one month to validate the bill in favor of a RIP which will then have to be supported by 4.87 million voters.

After the censure motion, the shared initiative referendum (RIP) could be at the center of all attention in the coming months.

On Friday morning, more than 250 deputies and senators signed a bill in favor of a RIP.

It affirms that

“the legal retirement age cannot be set beyond 62

years”

.

It was filed that same day on the desk of the President of the National Assembly, Yaël Braun-Pivet.

According to information from Le

Figaro

, it was deemed admissible and was sent to the Constitutional Council on Monday.

The Elders now have a month to examine it and validate or not this procedure.

“It could only take a few days”

, slips a senator.

According to him, the RIP should even be studied before appeals to the Constitutional Council on pension reform, filed on Monday.

4.87 million signatures needed

Next step: the bill on the RIP will have to be supported by one tenth of the voters, or 4.87 million people.

Signatures must be collected within nine months.

“It is a bill which cancels that of the government”

, indicated the PCF deputy for Seine-Saint-Denis, the first to have mentioned this path of opposition to the reform.

“If the threshold of voters is reached, the Constitutional Council will make a

decision in this direction.

Parliament

will then have six months to examine the text and failing that, it

will be submitted to a referendum,”

constitutionalist Jean-Philippe Derosier

told Le

Figaro .

“If we have the 4.9 or so

million signatories, this referendum will be imposed on the President of the Republic”

, judge Stéphane Peu.

“I don't see how the president could not choose the referendum if there was such popular support for

the

RIP's approach,”

confirms Socialist Senator Patrick Kanner.

Introduced into the Constitution in 2008, the RIP has so far only been used once, in 2019, against the privatization of Aéroports de Paris.

This first RIP, however, had only collected 1.1 million supporters.

"The

collection of support is the responsibility of

the State and due to technical difficulties on the old website, the Ministry of the Interior did not then show goodwill"

, recalls Jean-Philippe Derosier.

Monday evening, Matignon announced that Elisabeth Borne was going to seize

“directly”

the Constitutional Council for an examination of the text

“as soon as possible”.
