The Supreme Court of Justice has in its hands the case against Alberto Fernández for the Fiesta in Olivos

Although the San Isidro judge accepted the payment of "financial compensation" by the president and his wife, the highest court must decide whether to accept the complainants as plaintiffs in the case.


Alberto Fernández has

not yet managed to close the only case in which he has been charged

.

This is the file that federal judge Lino Mirabelli has in which

the party that was held in the Quinta de Olivos

was investigated when a strict quarantine was in force throughout the country.

The President and the first lady

Fabiola Yañez

- whose birthday was the reason for the illegal meeting in 2020 - made an economic agreement to archive the file, but despite having already paid the compensation provided for in the law,

 the dismissal cannot yet be signed because there is an appeal that must be resolved by the Supreme Court of Justice.

On July 14, 2020, in the midst of the restrictions due to the pandemic and despite the fact that they had officially announced a virtual celebration, the first lady Fabiola Yañez organized

a party with Alberto Fernández and a group of friends inside the presidential residence in Olivos.

The Justice determined that she was guilty of the crime of violating the regulations that restricted those meetings.

On that occasion, Judge Mirabelli recalled that "the production of public and private events of a social, cultural, recreational, sports, religious and any other nature that involved the attendance of people" was restricted.

Despite the letter of that DNU signed by Alberto Fernández, on July 14, 2020, ten people went to Olivos to celebrate.

They entered at 9:46 p.m. and left after midnight

after the First Lady's birthday celebration.

Alberto Fernández, Fernando Consagra, Emanuel Esteban López, Santiago Basavilbaso, Florencia Fernández Peruilh, Rocío Fernández Peruilh, Severina Sofía Pacchi, Carolina Marafioti, Stefanía Domínguez and Federico Abraham participated in that event.

They all

withdrew from the presidential villa in Olivos, at 1:44 on July 15.

Two years after that celebration, the criminal case that began in August 2021 has not yet been closed despite the fact that Alberto Fernández and Fabiola Yañez made an economic agreement approved by Mirabelli.

But

that dismissal is not firm.

It must be remembered that the President and the first lady reached a comprehensive reparation agreement contemplated in the Criminal Procedure Code, with the prosecutor

.

In total, a payment offer of three million pesos

($1.6 million Alberto Fernández and $1.4 million Fabiola Yañez)

was accepted .

The money was obtained after a bank loan requested from the Santander bank (of which the President has been a client for years) and immediately afterwards, the lawyers proceeded to make

the deposit in the account of the Malbrán Institute.

In cases related to the violation of the quarantine, the prosecutor Domínguez always evaluated the economic offers based on medical supplies or days of hospitalization for Covid cases.

The dismissal has not yet been signed because there were oppositions to the resolution of the case.

Those appeals were granted and Judge Mirabelli was awaiting the resolution of the San Martín Chamber, which was known at the end of last year and which endorsed the magistrate's criteria when he approved the financial agreement.

But at the same time,

the complainants asked to be included as a complainant

in the file.

That proposal was dismissed by the judge of San Isidro and, once again, his criteria obtained the support of the higher instances.

The complaint, however,

reached the Supreme Court of Justice, 

the court that concentrates all its criticism of President Fernández as well as the vice president, Cristina Kirchner.

Both

promote the impeachment of the four judges of the Court.

According to judicial sources explained to

Clarín

, until the highest court rules on the matter,

the investigating judge will not sign the dismissal

expected by the head of state.

In the meantime, the case will remain open and despite the economic agreement already materialized: the money was received by the health institutions and applied to the corresponding expenses.
