Dizziness at the weekly market in Freilassing?
An attentive customer discovered that a retailer there had resold Kaufland cheese for an exorbitant price.

There are plenty of products from their own production or at least from the region.
But that is apparently not always the case, at least judging by what happened at a weekly market in Bavaria.
A retailer there has now sold a Kaufland cheese to his customers for a whopping seven euros.

from IPPEN.MEDIA, the Berchtesgadener Land district office confirmed the incident of the sale of Kaufland cheese at the weekly market in Freilassing.
"Due to the information about the cheese cubes sold at the weekly market to the district office (takes place on March 9th), on March 11th
a status check has been carried out.
This confirmed the suspicion that the cheese in question was purchased from Kaufland.”
Apparently, the retailer had simply removed the label on the jar and the serial number on the back of the herb cube cheese.
However, he probably didn't do it carefully enough.

The trickery became public when a suspicious customer first stumbled over parts of the label that were still on the glass.
According to information from the
Passauer Neue Presse,
the customer researched and found that it was a well-known product from the supermarket.
As a result, he wondered about the price in a public Facebook group – not like a customer biting into a Kaufland croissant – which led to the swindle coming to light.
"My wife (...) bought a cube of cheese at a cheese stand, believing that there would be something special to celebrate the day.
The price of 7 euros for a glass surprised them a bit, but nowadays some things are surprisingly expensive.”

"Understandably, this behavior appears opaque to the consumer," the district office continues.
But does the exposed scam have any legal consequences for the retailer?

The short answer is: no.
Because even if the sale of Kaufland cheese at the weekly market looks like intentional deception, according to the district office, "the behavior is not objectionable from a food law perspective".
The retailer does not have to fear any legal consequences.
"According to food law, the decisive factor for the consumer is information about the manufacturer of the food, the intermediary or seller to the end consumer is irrelevant in this regard," explains the district office.

"The information about the manufacturer and the contents of the glasses (ingredients, etc.) was correct and therefore not objectionable," the district office continues.
"The product was also not advertised with claims such as 'handmade' or 'from the region'."

Nevertheless, this practice is by no means the rule, but rather an exception, which is nevertheless just as disappointing as the feeling of a Kaufland customer who recently bit into a ham and cheese pastry.
"Of course, such a practice is still not to be approved," the district office takes a clear position, "since the consumer at a weekly market usually expects handcrafted products from the region and the product on hand did not meet these expectations."
Even if the incident has no legal consequences for the retailer, the seller agreed to withdraw the products from sale on a voluntary basis and promised not to sell Kaufland's herb cube cheese in the future.
At the same time, the district authority makes it clear that the market operator also bears a certain responsibility.
"In addition, it would be up to the market operator to regulate which products of which origin may be sold on the market."
