The mayoral elections in 2022 in Dresden and Zittau do not have to be repeated - and the mayors are allowed to remain in office.
This is the result of four judgments of the 7th chamber of the Dresden Administrative Court, as announced.
The court dismissed all lawsuits on Thursday.
Dresden/Zittau – In three cases, citizens had sued against the mayoral election of July 2022 in the state capital Dresden.
Among other things, they opposed the admission of incumbent Dirk Hilbert (FDP), who was successful in the second ballot.
The verdict stated that the irregularities were not of sufficient weight to invalidate the election.
There had been numerous complaints against Hilbert's admission to the election even before the election.
However, the state directorate only saw minor formal and procedural errors when it was drawn up.
"No essential procedural regulations have been violated," said Jens Roth, head of the department for municipal law issues at the state directorate, about a year ago.
With regard to the Dresden election, it was also about the late sending of postal voting documents, which the plaintiffs believe should have led to the election being invalid.
However, the judges considered the objections that, in a large number of cases, election documents had been sent out late, to be insufficiently justified.
In the case of the mayoral election in Zittau, the winner and previous incumbent Thomas Zenker (Zittau can do more) was accused of election manipulation by a losing competitor.
He himself was voted out as second deputy mayor six weeks before the election at the instigation of the incumbent.
The court did not see sufficient evidence that election manipulation had to be assumed, as it was said.
Those involved can lodge an appeal against the judgments with the Saxon Higher Administrative Court within one month of the judgment being served.
