At the regional court, Matthias Braumandl today sentenced a child molester to three and a half years in prison for sexual abuse - but the judge did not release the accused Daniel B. without giving him his opinion again.

In numerous cases, the accused sought contact with girls between the ages of 13 and 16 via online platforms and then sometimes met the girls, Braumandl explained.

Daniel B. had performed sexual acts in front of and on the injured party.

In addition: B. offered money for these sexual acts in some cases, but then did not pay - the accused also "possessed numerous child pornographic material".

For this, Matthias Braumandl cracked the sex offender – and took him to his chest.

The presiding judge emphasized that the accused was a "fake" whose "absolute core competency" lay in recognizing the needs of vulnerable girls between the ages of 13 and 16 and in surreptitiously gaining their trust.

In some cases, he promised money to the injured, and he “told stories” to everyone.

All cases have in common the exercise of extreme dominance by an adult over the child and adolescent victims at the meetings.

The accused's behavior met the definition of "cybergrooming," Braumandl complained.

Laurent Lafleur: "Chairman Matthias Braumandl criticized the accused for his statements in court, with which he assigned the injured party - alleged - complicity in the acts." This attempt to "neutralize" his acts failed.

The defendant also recognized the child age of the injured party.

The accused was fully culpable when committing the crime, says Lafleur.

"He was also aware that his behavior was punishable."

Daniel B. had admitted the charge, which was taken into account in his favour.

“The chamber assessed the long period over which the defendant's actions were spread out to the detriment of the accused,” says Lafleur.

"The court also assessed the fact that the accused had abused the trust placed in the children and young people as an aggravation of the sentence." The verdict is not yet final - the defense and the Munich public prosecutor's office have the right to appeal to the Federal Court of Justice.
