Because every week that goes by, the fine for restaurateur Dietrich Sailer (66) increases - by 10,000 euros each...



Since 1995, Sailer has been the landlord of the popular Villa Flora in Sendling-Westpark.

The city gave him the villa on long-term lease - on the condition that the house should be run as a middle-class inn "Old Munich tradition" for large sections of the population.


The city's municipal department does not consider this condition to be met - and is now demanding a contractual penalty of EUR 500,000 from Sailer.

Reason: The villa was only open on 15 days in 2022 - and therefore does not correspond to the model that every citizen should be able to stop there.

But that is exactly what is very important to the city.

In the contract with Sailer, it has accordingly included a contractual penalty.

39,000 euros per month are due for him if he does not comply with the municipal tavern specifications.

"That's insane!

A tavern outside the Altstadtring has not been profitable since Corona at the latest.

We can't afford that," says Sailer - and is now suing the city.

Yesterday there was a hearing at the district court - and immediately there was a dispute about the contents of the contract.

According to him, the 15 events were “accessible to everyone”.

However: with an entrance fee, for example for a “Spanish evening”.

Sailer criticizes: “The villa will die without these celebrations.

Roast pork alone is not the solution.” The judge countered: “I would be interested to know when I can go out to eat at your place.” Because the city suspects that Sailer organizes many lucrative – private – events for him.

The entire location can be rented online for around 5,300 euros per day.

“The contract only says that the villa has to reach the general public.

And not when we should open,” says Sailer.

"We can negotiate about that - also about our food offer.

But not with a contractual penalty behind you.”


Now a professional mediator should help – until then the city's punishment is suspended.
