After a trial by the Oral Criminal Court (TOC) 1 of San Martín, Fernández was found guilty of the crime of "aggravated homicide due to the victim's status as a woman, for having been committed mediating gender violence and for employment of a firearm", as well as "illegitimate possession of a firearm for civilian use, which materially concur with each other".


The sentence was handed down by judges Héctor Gustavo Toneguzzo, Alejandro Moramarco Terrarossa and María Inés Piñeiro Bertot, after prosecutor Enrique Raúl Velazco Cerviño requested the maximum sentence for the defendant in his arguments.

According to the accusation, Fernández was obsessed with the victim, he wanted to have a sentimental relationship with her at all costs and since she always treated him as a friend, he killed her.


During the development of the debate, more than a dozen witnesses passed through the room, including relatives and friends of Luján, experts, police officers and the mother of the defendant himself.

All the testimonies agreed that Luján considered Fernández only as a friend and co-worker in the maestranza sector of the Trenes Argentinos company.

"We always knew that my sister did not commit suicide, because Sergio himself killed her. He wanted her to be his partner and she only wanted him as a friend. It was pure obsession with her. He lied to everyone and a person does not commit suicide with two bullets ", he added.

The femicide was committed on Sunday, March 3, 2019, in the victim's apartment, located at Amadeo Sabattini at 4700, near the corner of Lisandro Medina, in Caseros, Tres de Febrero district.

Relatives of the woman arrived at the apartment and, since she did not answer the calls, they entered the building and on the fifth floor they found the entrance door ajar.

Finally, the woman's body was found in her bedroom, in a pool of blood, with bullet holes in both parietals of the skull.

The police personnel also verified that there was no disorder in the apartment and that Luján had packed the suitcases since he was going to travel on vacation to Cuba.

From the beginning, the attempted robbery was ruled out and they focused on the fact that the perpetrator of the crime could have been someone they knew, so the family provided information about their friend who had become obsessed with her and who had the keys to the house. of Carmen, who was detained.
