With a K defeat, the Council of the Magistracy appointed its vice president and integrated commissions

The ruling party could not impose former deputy Héctor Recalde as number two of the body that proposes sanctions and dismisses judges.


The Judicial Council today appointed Judge Agustina Díaz Cordero as vice president of the body, after

Héctor Recalde was rejected as a Kirchnerist candidate for that key position,

while he unanimously integrated its five commissions.

The 18 counselors, plus the head of the Court and president of the Council, Horacio Rosatti, reached this consensus after intense negotiations and an exchange of accusations that delayed the start of the first plenary session of the year for an hour.

working for moves by former president Cristina Kirchner.

Then the former director of AFI Counterintelligence and ultra K deputy Rodolfo Tailhade complained because thus "the two highest positions of the Council of the Magistracy are for the same estate", that of the judges. That is, Rosatti and Díaz Cordero.

But Rosatti is in that position because he is the president of the Court, not by choice of the judges.

"We are going towards a Council managed by the judges when nowhere does it say that this should be the case," said the deputy and judicial operator of the former president.

In the same sense, the Kirchnerist senator and son of Héctor Recalde, Mariano Recalde, affirmed that "this Council is managed by the judges to guarantee them impunity."

Recalde linked the vote to the political trial that the K initiated against the Court in the Chamber of Deputies.

One of the controversies is that the opposition is not willing to agree on appointments of judges that include replacing Leopoldo Bruglia and Pablo Bertuzzi in the Buenos Aires Federal Chamber, appointed by transfer during the government of Mauricio Macri.

The answer was given by the radical deputy for Santa Cruz Roxana Reyes.

"We have not come to protect judges,

we have come to prevent attempts to manipulate the Judiciary

" by Kirchnerism.

"We are not going to allow the subjugation of Justice with that obsession that Kirchnerism has of going over the powers of the State and, specifically, over the judges," Reyes said. 

With the election of authorities, the Council would be in a position to approve competitions for magistrates, a task that has been suspended for nine months due to the obstacles put up by Vice President Cristina Kirchner.

The five commissions that were integrated are those for the Selection of Magistrates and the Judicial School;

Discipline;

Accusation;

Administration and Finance and Regulation.

The vote in the plenary is the obligatory step for short lists of magistrates to be elevated to the Executive Branch or the removal of a judge is defined, among other powers.

As a result of the declaration of unconstitutionality of its integration in December 2021 by the Court and the illegal appointments of directors by the vice president, the Council could not hold a plenary session.

The Supreme Court declared the integration of the Council unconstitutional in December 2021 and then challenged the election by the Senate of Senator Martín Doñate, promoted by Cristina.
