Munich – Alfons Schuhbeck (73) will have given himself a few days of rest over Easter.

But he will soon be faced with a new legal dispute: The Messerschmitt Foundation has sued the star chef and is demanding that he vacate his apartment in the Orlandohaus at Platzl 4 in Munich, which he rented there privately.

Background: According to the foundation, Schuhbeck is said to have - at least temporarily - accumulated rent arrears or paid the rent too late.

That's why the foundation had terminated him.

But Schuhbeck resists this.

That is why the district court in Pacellistrasse must now negotiate the case.

Court spokesman Martin Swoboda confirms the date to our editorial team and says: "May 9 is scheduled as the main hearing in the tenancy law procedure for clearing the apartment on the Platzl."

Then it's about Schuhbeck's home in Munich.

Because the star chef has “no other home,” says his lawyer Dr.

Joachim Borggrafe.

He had recently repeatedly denied rent arrears - and sought a holistic solution.

Accordingly, Borggräfe had already transferred 350,000 euros to the Messerschmitt Foundation in mid-March.

The payment already included rent arrears from Schuhbecks Company GmbH for the spice shop on Platzl.

It is currently still unclear whether Schuhbeck's private rent payments have also been offset - at Schuhbecks Company GmbH the star chef is only an employee on a fee basis.

"Nothing is cleared for me," Schuhbeck had already told our editors - in relation to the spice shop.

However, it is uncertain whether this also applies to his private apartment - that will only be decided in court in four weeks.

Because the Messerschmitt Foundation had already sued Schuhbecks Company GmbH for eviction.

And won: the title has been enforceable since March 15.

However: The foundation seems interested in a solution with Schuhbeck.

In any case, she did not apply for an enforcement order at the district court by Easter, confirmed court spokesman Swoboda.

At the same time, the revision in Alfons Schuhbeck's criminal proceedings is still ongoing: he had evaded taxes amounting to 2.3 million euros and was sentenced to three and two years in prison at the Munich I Regional Court.

Schuhbeck has appealed the verdict.

The Attorney General is currently examining the case, and the documents will soon be expected at the Federal Court of Justice, which will then decide on the case - and thus on Schuhbeck's fate.
