The Buenos Aires Justice ordered these judges
to put protection measures on the missionary hacker Elías Nuñes Pinheiro and his family
against the denunciation of suspicious movements in the surroundings of his house in Eldorado, Misiones.
The young hacker confessed to having hacked the cell phone of former Buenos Aires Security Minister Marcelo D'Alessandro, judges and prosecutors who investigated Cristina Kirchner and
gave clues to who hired him and the "brain" of the illegal intelligence operation.
Thus, Judge Araceli Martínez asked the Eldorado judge on duty to "
urgently order
protection measures aimed at ensuring the physical integrity of the accused Elías Ezequiel Nuñes Pinheiro and his family circle, for the duration of
this process
."
The request for protection was made
first by Nuñes's lawyers, Sebastián Noguera and Marcos Kapko,
and then by prosecutor Daniel Dupuy, in the presence of
"suspicious visitors
" at the home of the family who lives in Eldorado.
In a resolution, to which
Clarín
agreed , the guarantee judge Martínez recalled that "Nuñes Pinheiro is charged in this case and has provided
relevant information
for the continuation of the investigation, as indicated by the Prosecutor."
"Although article 38 of the Code of Criminal Procedure of the City of Buenos Aires, is directed mainly to
regulate prerogatives of victims and witnesses
, nothing prevents its postulates from being applied, "mutatis mutandis", to the situation of defendants," said the judge.
Above all "in those cases where their mere participation in the process may generate
a reasonable fear of suffering certain consequences
for their personal safety and those close to them."
Then he indicated that "taking into account the relevance that this investigation has acquired, the Prosecutor's claim is reasonable if it is evaluated in light of the statements made by Nuñes Pinheiro and the suspicious visit that he received at his home, as stated by his lawyer."
Nuñes lives in Eldorado and came to the CABA to extend his investigation last Monday in which he gave more clues about who hired him.
Nuñes's confession opened an investigation in the world of the dark web, espionage and politics whose scope is still unknown.
The hacking also affected the other “targets” -as defined by the hacker- the representative of Juntos por el Cambio Diego Santilli;
Judges Rodrigo Giménez Uriburu and Andrés Basso (both of the Highway Administration case);
the City Attorney General, Juan Bautista Mahiques;
and the judges of the Federal Chamber of Criminal Cassation Mariano Borinsky and Gustavo Hornos (who must review the sentence of Cristina Kirchner to 6 years in prison in that case), among others.
