The majority of the Court
rejected the complaints of its former administrator Héctor Marchi
and said that
a report on the Obra Social del Poder Judicial that is being debated in the Impeachment Committee of the Chamber of Deputies that manages
the
kirchnerism.
In a note sent on Monday night to the president of that commission Carolina Gaillard, the majority of the Court - made up of Rosatti, Rosenkrantz and Maqueda - recalled that in the institutional organization chart of the court, Obra Social is "located under the orbit
of the General Secretariat of Administration and the Presidency”
.
Social work is the responsibility of its board of directors and the Court "
does not have management responsibility
and its functions are limited to supervising it through the General Secretary of Administration", the response indicates.
Marchi was secretary general of administration of the Court for 15 years and has the support of former Court judge Ricardo Lorenzetti.
Kirchnerism filed a criminal complaint against Maqueda for alleged irregularities in the social work that, until now, has not prospered.
"The Court
never appointed
one of its members as supervisor of the social work," he highlighted in reference to Maqueda.
“
There was never a “Marchi Report”
from the General Secretariat of Administration of April 19, 2023. It only sent
a copy of reports that it had already presented
”, maintains the report of the majority of Rosatti, Rosenkrantz and Maqueda.
The Court's response also "explains why only the first report (on Social Work) was published and not the others" which was another criticism of Kirchnerism that was mounted
on the Marchi case and changed the agenda of the commission of Political trial.
Regarding the content of the last report where Marchi denounces "a loss of 2,700 million
is deceitful, partial and malicious
", the majority stressed.
"There was no such loss, they acted in the same way as in previous years and, if it had existed,
it was their sole responsibility
," said the majority of the highest court.
In the note sent to Gaillard "copies of other administrative files were attached proving that Marchi
was involved in the management of Obra Social funds,
that is, the so-called "remaining funds"".
"The existence of anti-cyclical funds since 2011 "
attests to the economic solvency of the social work
and its surplus situation," stated the response of the majority of the Court.
The former administrator was displaced last Thursday by the majority made up of the president of the Court, Horacio Rosatti;
the vice president, Carlos Rosenkrantz, and Juan Carlos Maqueda, with the dissent of Ricardo Lorenzetti, who criticized the transfer of the official to the Social Appeals Chamber.
The former president of the Court attributed Marchi's displacement to the content of "a report" on the movements of the social work of the Judiciary.
"We see a lot of seriousness in what Lorenzetti says because it shows that Marchi was going to send us very important information," said the president of that commission, Gaillard, in radio statements.
Gaillard sent a note to Rosatti on Friday asking him to forward the "report presented" by Marchi on the functioning of the judicial welfare work.
The Court sent the response yesterday Monday, before the Impeachment Committee of the Chamber of Deputies began a new hearing today, pending the testimony of the displaced administrator of the highest court, Héctor Marchi.
